I actually figured this out at least 2 years ago, but I guess with our health & safety society, it's probably a good idea to let folks know about this.
In my 2004 X3, with the key in position I, the automatic shifter lever can be moved into any position by simply pushing the shifter button. There is no interlock, nor do you have to push the brake pedal. Thus, it is a good idea to pull the parking brake whenever you park because the shifter can be moved into N. The shift interlock is only engaged in OFF or key position II.
