Just spoke with the shop tech manager at my local BMW dealer and he said the latest version of code BMW he has is 37 version 1 and 2. The next version due is 38 and is supposed to 'fix' stall or near stall. He has heard it is coming but has seen no SIB on it as of yet.
Maybe 39 is a version specific to the ZHP since it has different code already?
He told me to contact him weekly via email for updates.

I've been getting the same crap from my SA's.
Obviously the NHTSA doesn't think there's a problem. I just got my letter from them yesterday.
Patiently waiting.
Just had my stalling issue checked yesterday. SA told me that they re-programed the DME with an updated version of software --- sure enough, stalling is gone :rofl: along with my Shark :cry:

Same thing from my SA. Just called yesterday and the shop foreman only knows that there is new version coming. No info on which one, when...

01, 325...update - Tried re-shark the car, got code 147 (new software). Sent the Shark back for update. Got a call today stating they need to talk to Jim to get the the Shark updated due to new software my dealer put in my car :yikes:

I never had this problem before, but do i need to get the S/W upgrade?? :dunno:
