View Full Version : Be aware of Virtual Junkyard

Hi,

I am a MB, not BMW owner. But, I would like to let you know what happened to me and be aware of it. I hope it will not happen to you.

Here is my story.

Three months ago, I found the company, Virtual Junkyard, in Texas selling used body kit, headlight, taillight... I contacted David Munoz, the sales, and to order a 99 AMG front bumper for E-class. He asked me to send them a check as payment. I thought it is OK, because it is a company at that time....

I sent them the check on 2/5/05, and received a bumper on 2/20/05. But, it is a CLK W208 AMG bumper, NOT for E-class. I contacted David again. He promised me I will get the right bumper "next" week. However, nothing!!! I tried to call him many times, almost everyday after a week. He rarely answers my phone call. When he accidently answers, he always tell me, "let me check out what is going on, and call me 30 minutes later", and hangs up rapidly. Of course, he would not answer my phone again. I also write him email, the same thing, no response. I just keep calling and leaving message...

Now, my money is gone, and I got a CLK bumper occupying space....

My friend told me, I can't do anything with it. First, I can't sue them from California. Second, it is not fraud, because they did send me a bumper, just wrong. I felt so frustrated about it. If anyone knows what I can do, please advice me. Also, if anyone looks for bumper, headlight... whatever, be careful with them.

Have you tried to call the BBB on them? Maybe they will help.

well they may not help...it will put them on the list with the government and the complaint helps them investigate fraud, and can lead to law enforcement action.

I also checked Better Business Bureaus' website, and found the same phone number with different address.

I should search Better Business Bureaus' website before sending them money.
Based on BBB files, Virtual Junkyard is not a menber of BBB and has an unsatisfactory record.
I am going to file a complaint first!

I sent the bumper back on 8/15/05, but, I am still waiting for their check.
It has been three months. :dunno:

Try suing him in small claims court. The fact that he advertises on a website should be enough to invoke the jurisdiction of the California courts. The procedure should be pretty simple. Look for the procedures on your State's website, probably the attorney general's. You should be able to get service on him by mail. When you get a judgment, you can send it to Texas for execution on any real or personal property, file it with his county's recorder against any real property, or you can garnish his wages or attach his federal or state income tax refunds. Filing the lawsuit should at least get his attention.

I would only use a credit card for such transactions. I'd also make sure that the request is in writing so that if they do send you the wrong part, you have some evidence of what you requested.

Finally, I received $150 refund after lots of phone call on 10/13/06. It is more than 18 months after I sent them the $400 check on 2/5/05. However, I had to agree with the $50 lose. :dunno:

Better than lose $200....

I live in Houston and have purschased many parts from virtual junkyard for rebuilding cars, good people. They have changed management and employees due to the threads in the past, I heard the owner was not happy and fired a few people.
