I think you're missing the initial premise of CPO being 6 years/100,000 miles. That's the period & mileage BMW commits to cover; they don't throw away anything in your scenario, as it's already taken...

May be you dealer added DEF in between? In any case, BMW doesn't recommend filling the tanks up to the top of filler necks, citing leakage from the vents. I never had such issue, though.
