I've heard the rate they get reimbursed from BMWNA is much lower than the rate for out of warranty repairs so you can guess why they're more inclined to fix non-warranty repairs.

Not sure either but was the knob shorter? Did it have the short shift kit? I guess you'd have to compare it to another E46 to really tell.

Check the exhaust to see if it has a flap, if it doesn't...
