The good news, unless you bought the new starter on eBay, you should have no problem getting your money back or a free replacement. New BMW parts carry a 24mo/unlimited mile warranty.

Have you had the oil filter housing gasket addressed? My bet is that's your problem. Every E60 sooner than later has this leak. Mine was repaired under warranty @ 55k miles.
