Leaky valve cover gasket is fairly common, and unfortunately CPO won't cover it. Unless I'm wrong CPO only lasts 6 years from in service date, so not likely a 2004 is covered at all.

In my experience, BMW auto trannies are suspect. I don't abuse my cars, but I do get on the gas & use the sport/manual mode a lot - why wouldn't I - and I have had 2 trans failures on 2 separate cars...
