At least in the E46 M3, 5th gear had no speed limiter, only 6th gear. I wouldn't be surprised if it's the same in the MZ4.

Replacing the O2 sensor will make the car run better, possibly solve your black smoke, and possibly solve your idle issues.

Evap issues are no fun and just require going over the fuel vapor lines.
