Yep. They lock the cover down when the top is either up or down.
If the rubber seal is bad, you can go to WWW.realOEM.com and look up the part number to get a new one.

Remove the trim ring around the release lever, remove the rear seat(both bottom & back then remove the side panel to access the lever. You may be able to access the latches also.
