Fail safe normally is not a transmission issue. It is to protect the drivetrain when there is an issue that can cause problems if not corrected. Most often it is a battery/alternator problem.

Probably because they were not produced by the company who manufactured the defective bags. My E46 Touring was recalled for the passenger side.

Oh yes the Vanos Seal reminder. Replacing Vanos seals have been known to cure everything, including the clap. I've seen cars with 190k and the Vanos still operated within spec. Don't buy into it.

I'm 70 and have been buying BMW, Mercedes Benz and Audi automobiles since the 1970's. Never have owned one that has been visually modified. I did install a Parrot Bluetooth system in my E46 Touring....
