You need to talk to BMW NA and push this issue. I had a 07 4.8 that was terrible. I ended up with a trade asist to a 10 35D. The SUV ended up being no cost to me. It is also perfect with zero flaws. For awhile I never wanted to drive another BMW now we are thinking of a second. In my case you do need to raise a stink and be the squeaking wheel.
