It makes no difference if its a lease or purchase, law is exactly the same.

talked with a lawyer friend last night about lemon law and unfortunately, since its a lease we probably dont have much stroke. we could proceed but it would be a huge hassle. we'd be in a better position to go the lawyer route if we had bought it. at the mercy of bmw north america.
