I had this exact same problem with a previous X5. I took it to an indy who changed the transmission fluid and filter which cured the problem. BMW say that the transmission fluid is ok and sealed for life but after several years it does break down. Get your transmission fluid and filter changed and it should be ok. It cost me 300 to get the job done.
