Good thing you are okay, I would suggest to trade in the car, totalled or not.
After such an impact the needed repairs will not give you the car you owned before the accident.
Honestly Speaking i am pretty shaked up as it is my first time getting in to accident .... i am back to my Accord i will be staying there for some time.... All i am worried abt right now is to get it totaled.
I'm sorry to hear the bad news, but I'm glad you are okay. I did a little homework for you and NADA shows your car is worth $55-60k (depending mileage and options).
Automobile insurance policies in NJ generally do not cover "deminished value" claims. Rather, the standard policy language usually states that the liability carrier will pay either the ACV (acutal cash value of vehicle) or the cost to repair, whichever is less. The standard policy language does not provide for an additional payment for the loss of the car's value as a result of being damaged. You might be able to sue the individual who hit you for it, but the insurance carrier is not responsible for the payment. (It is not easy to collect a judgment for damages not covered by an insurance policy.) Given the substantial damage depicted in the pictures, I would push for a total loss. I do not think that you would want that vehicle back after the repair. You need to get your body shop involved to obtain an opinion on the real total cost for the repair. It might be in your interest to have the dealership's body shop do this because an independent body shop (that does not sell cars as part of its business) has no incentive to convince the carrier to total the car. Finally, looks like you were in a bad accident and the driver's side where you were sitting took the brunt of the impact. Even though you think that you are o.k., I would get checked out by a doctor as a precautionary measure. Good luck and I am glad that everything seems to be o.k.
Dreamcar, Do you have the option to take the cash if they dont total the car? Either way, I would sell that car, it will never be the same. Glad you are ok, its only a car, it can be replace.
So glad to hear that you feel OK and not apparently hurt right now, but remember you're probably still running on adrenalin, so like the earlier poster said, get to a Doc. soon and have a thorough going over. Sprains and bone misalignment can take days to show up, and longer to heal. Hoping you get a quick settlement in your favor with no future worries.
DreamCar, I just checked the boards and saw this. I am so glad you are ok mate. The damage looks pretty bad, but I have seen local shops fix worse. This car is pretty loaded and I would want to be made whole as well.
I hope you do not have any injuries. If you feel that the insurance people (I assume it's of the person that hit you) give you hard time, involve a lawyer. You will not believe how much they change the tone when legal representation is involved.
I am not saying you should sue them, I am saying that lawyers are known to be better negotiators. This is all pre-emptive, but just offering my 5 cents.
Important thing is you are okay.
I am working for an insurance company (in Canada though) and I showed the pictures to some other guys here at work. Can't say for sure but there is a good chance that your car is having some structural damage, by the looks of the car that hit yours. Usually the insurance companies would consider repairing, if the costs are up to 80% of the actual vehicle value.
Main thing is you your safe. I know it's stressful, but you're in one piece. Good luck with the insurance companies and hopefully everything goes your way.
Well i just got a call from the apraiser he is saying it will most likely be total loss.. still awaiting on the official confimration..
The sad thing is it is priced at 57K which is less than my finance (even though i bought it for a very low price because of the ED+Incentives etc:- ) i am really bumped that my car valued so less.
It sounds like it will be totaled which will ultimately be good for you. The GAP insurance was a good move on your part. I bought mine outright so you can't buy GAP insurance and would have to take a depreciation hit.
However, to protect myself, I pay $85 a year for full replacement coverage if a totaled collision should occur; i.e. I get a new current model car for up to two years.
Once again, GL
Well worth $85 per year. I imagine you can do the same even if financed, with or without GAP, as GAP would still leave you well short of the replacement cost.
Sorry to hear about your accident. Glad you're OK. In the end it did it's job which was to protect you and crumpling up like that absorbs lots of energy.
What do you think they do with the wheels if they total it? I'm looking for a set of used rims to use for my winter tires. Was that front driver side wheel hit?
Take good notice of the advice given by some posters about your own health.
Get a very thorough physical check and put a specialist on claiming any loss of your own well being.
I was once hammered in the back and did not claim any personal harm on the other driver.
That was a mistake, I have neck problems since that impact, but I only got aware after a couple of weeks.
Do get a medical chek, it will not harm and will probably get you a different financial settlement.
Incident effects will be noticable on your body and mind that is for sure, blame the other party by using a proffesional and let them settle.
You did not just looose your dream car, that is gone, but you will as well experience other negative effects.
It is not your insurer who has to pay, it is the insurer of the other party in the accident.
Or am I mistaken and do you have any blame yourself for the tboning?
:stupid: In 1982 I was at a full stop, waiting to make a left turn, and was rear-ended by a distracted driver going 40 mph - he never even saw me, let alone touched the brakes. My Audi Coupe was totaled. Because I was a young stud, I did not get checked out. 30 years later I still get intermittent neck and arm pain from the effects of the whiplash.
Get a THOROUGH exam. Pay attention to anything out of the ordinary. Consider consulting a personal injury lawyer. The mere fact you have on "on your team" will put you in a much stronger negotiating position.
Any accident you can walk away from is amazing. Hope everything is great health wise dreamcar. I too would note any difficulties you have and bring it up with your pc physican. Not cause you want to hire a personal injury attorney or something, but Caz of your health, cars are designed to take massive forces , you on the other Hand are not, so get checked out. From there go with the advice of everyone here.
In regards to your vehicle, as long it's totaled, I think your gonna be good. I hope everything works out, and the only bad thing to take away from this incident are the memories of the incident.
Honestly speaking i am very impressed ... the xpel is still intact despite the damage... i had to rip it hard to show it to the appraiser unfortunately the 1600$ i spent on it doesnt count in the appraisal process
OMG, what a disaster! I'm glad you're ok.
i'm glad that you didn't do much upgrade on your car yet (big thanks to Dinan), as i put almost 20k of upgrade on my audi before I had to get rid of it.
at least you're fully covered and have the chance to walk away even.
This is why you have to show them the built out cost, and show them benchmarks like mine.
Also you can just go on autotrader and try to find a 2012 with a similar spec used. See what its listed for.
BTW I did PCD and I did get a window sticker. I had mine laminated so it could be passed on the the next owner.
