Lemon Buyback

I just got a call today telling me my 07 335i I bought in June this year was actually a lemon law buyback from the original owner (I'm the second), and that it should never have been resold to me by the dealer I bought it from, who had purchased it at an auction.



I was told they could either offer me some money to compensate me for the mistake and I keep the car, or they will buy it back from me for everything I have into it, including anything I have added after I bought it.

I'm expecting to walk away with a check for about $30k after paying off what's left of my loan (about $8k). I bought it for $38k out the door, financed $19k of it, and have paid it down to the $8k now.

The car has had some problems since I bought it (new idrive installed, replaced window actuator, squeeky wheel).

So what do I do?

I will take the buyback as I don't want a car with a salvaged title, but then what to do with it? 2009 335i? Low mileage 08? When will the 09s be delivered? The new idrive/nav/hard drive looks mighty tempting...

Either fo with the 09 and get the new I Drive, or see if you can find a new 08 with .9% financing and option credit, put your 30k in the bank.

It looks like they are going to make you whole on the $ side, so you really cannot lose, except that you will probably have to get something new instead of used, that means more $. You can:
- try to find a similarly equipped 08, brand new, 0.9% and put the money in the bank. This late in the game, finding the model may be the hardest, but if you do, you could get a screaming deal on something brand new
- wait and get an 09 with a good deal, courtesy of BMW and the dealer
- find another CPO
Either way, you probably should negociate like the original owner protection plan for free...

No, I'm definitely not keeping the car.

I will say that they seem to be very concerned and willing to make me whole.

I'm thinking I will look at the 09s.

There doesn't seem to be much difference in price between the new 08s and 09s, and not much of a discount for slightly used 08s...
