wtf.. what should we do

Here's the story:

We go to pick up my mom's X3 last Friday but our sales guy heard a "noise" so they were going to work on it and when we got back from London we would pick it up Monday (3/21). My mom gets an email today saying "with your X3 being as new as it is, this is not an issue the shop has seen before. The noise is emanating from the torque converter." He continues saying BMW has recommended a procedure they will do Monday (3/21) and if that works, it will be ready the next day, Tuesday.

So our brand new X3 already has a noise that BMW isn't sure how to fix, I doubt they have tried to do anything during the week they could have

Frankly, I dont want my mom to have a car that is already sh*tting itself, a potential lemon.
They already gave them the money on Friday

what to do?

If you haven't taken legal possesion I doubt any laws would say its yours. Tell them you want a new one and see wha they say. Or, spend some money and get an attorney's/barristers advice. Couple hundred US or Quid is certainly cheaper than the thousands you spent on it.

Do not take possession.

+2! Under no circumstances drive it off the lot. Tell them you do not want that car, but want another one (you might have to wait, but it will be worth it -- if only for peace of mind.

I guess they signed all the papers and whatnot and that it was while they drove it to the thing that he heard it.
Sounds like they heard the noise, wanted to hold off until it was sold and then deal with it. Can you say scum?

well we have the car right now and it seems great. I mean, the thing does have a 4 year warranty so if anything does go wrong it's just hassle

the new idrive updates (from an 09 view) are kinda nice.

I don't know about him, but I also find the bug very annoying.

I think it's kinda funny. Certainly nothing to get worked up about.

I agree with the others don't take delivery as this can only be the beginning of problems to come. If the dealer is scratching their head that is not looking good

Its one of those things that is funny for about 10 seconds and then just gets annoying. However, this is about a serious bug in a brand new vehicle that given BMW's history for dragging things out no way would I take possesion of that SAV.

Andy, please let us know what you finally decided to do and how it worked out.

Lol, I just noticed the bug on the screen until you guys said there was.

But replying to the OT: Weird situation you have, but I guess just go on with it and listen to what they say.
