TCU replacement

So I bought a CPO 2008 X5 from a dealer and after bringing it home and trying to set up the BMW Assist system realized it wasn't functional. I brought it back to the dealer who reluctantly took it back to fix the problem. After inspecting it they determined it needed a new TCU (telephone control unit). They've had it now for 5 business days (plus two weekend days) and its still not ready. Dealer first claimed they needed to get a code from BMW they didn't have but that was last Friday. Has anyone else had any experience with this issue? I hate to say it but the dealer seems incompetent for taking this long.

Little known fact:

Car that is out of warranty and has 'issue' must be fixed at the dealer's expense prior to sale or prior to CPO. However, if these issues 'occur' after the thorough and precise CPO inspection, then BMW pays the claims.

The software on these cars is a mess....

Another day without getting the X5 back from the dealer. Called them and they claim it is because they haven't been able to reach the one person at BMW North America that has the codes necessary to activate the TCU. Sounds ridiculous but they're letting me run the mileage on the 335d loaner so its not all bad.

Ok now the dealer got the code but couldn't complete the installation due to software bugs. So now I am on day 9.
