Dang It!!!!

So driving home, a driver trying to cut into my lane, hits my car. The front bumper of her car hit just behind the rear tire and carried forward to my mirror.... The driver then tries to leave the accident and i had to jump on tha gas to get in front of her and force her to stop. she then precedes to lie to my face and say she did not move over on me. She claims she wanted to turn left at the freeway but was in the middle lane. I was in the right lane, planning to turn right. Well after we get information and leave, guess what.... She turns right heading the direction for the lane I was in. I'm furious she lied to my face and tried to push off the blame and fault to me. I'm extremely angry that my car is damaged from the back to the front, after the weekly washes and zaino layering... Someone intentionally damages my hard work just to cut into traffic.

How did the police report go? Did she lie when the police responded to the accident? Did you have someone in the car with you, or did she?

Absolute BUMMER! I've had to make multiple evasive maneuvers in the past year to avoid a similar situation...with a car moving into my lane...several times because they were TALKING ON A CELL PHONE.

That is a bummer, so sorry to see this. The last couple of days with our afternoon rains, drivers have been even more moronic than usual. Unfortunately, this is a real life example.

If you need a top rate body shop, Katy Coachworks on Blalock does excellent work. They have done numerous repairs on my bosses MB (his daughter is a disaster around cars). Last time I had to take the boss over there they had a Lambo from California in the workshop.

Did you have any witnesses?

I'd file a report and then get insurance on the line. It should be pretty obvious that she was lying based on her address. Most people in the afternoon are headed home, so a left vs. right turn should be evident.

Thinking about a similar scenario, a "hit and run," my thinking is to contact BMW Assist as you attempt to get a description of the car...the license plate number, although I know the cops DON'T LIKE the "victim" to pursue.

I'm expecting that BMW Assist will call the cops and relay the information "on the run," but am not sure if they'll "relay" information from the "pursuit" car (BMW) to the police? I tend to doubt it. The cops (once contacted) will certainly advise to discontinue any pursuit IMO.

So your car gets hit and you only care about the washes and the zaino? That's dedication.

Thanks guys, there were plenty of witnesses however none stopped to assist... The police have my word vs hers and the insurance will have to figure it out I guess. No tickets were issued and in time I can get a copy of the report if I wish. One of the officers was confused because of how we stopped, with me angled in front of her blocking the lane. This was to stop the other driver from fleeing the scene but idk how this will fair when the police report is files. The other driver was not going to give me her insurance until the officers came and he handed me it to take notes.

Ummmmmmmm. This is why I always stop when I see something and leave my card w/the victimized party. Yup, I'm always called by an insurance company or two to testify by phone.

Good news! If the scrape was entirely behind the front wheel, she's gotta major prob attempting to blame you. That it started back of the rear wheel's def in your favor - talk with your insurance company for soothing advice, this regard. That she's saying what you mention oughta seal the deal.

I have used them before on a previous car and yes their work is excellent. They are one of only a few high level certified Aston Martin repair centers. I know Star Motors users them as well for the Lotus & MB collision. I'm not sure if I will use them or Momentum Wests Collision center. I kind of like the idea of using a BMW center for this since the door has some dimple down to the bolts of the hinge. However, the website looks like they service all models so it might be similar to the large chain repair shops. :-/

To my knowledge, BMW still does not install event data recorders (EDRs). BMW would be one of the few auto makers that does not utilize them to this day (or at least does not admit to it). This would seem to be an "incident" where an EDR could "prove" that the OP remained in his lane and was struck by the other car, thus "insuring" that he was not at fault.
There is no federal (NHTSA) requirement to install EDRs.

I thought I would post an update and give my body shop due credit!

Thanks to the recommendation of Nordic Kat, I ended up using Katy Coach Works. I have had prior experience with them before and it has always been outstanding. This time was no exception; the car was put back into factory shape as promised and made a believer out of me.

I was able to meet with the insurance adjuster on June 27th and drop my car off shortly afterwards at Katy Coach Works. It's a treat to go to this body shop at times since they are an authorized Mercedes Benz and also Aston Martin certified collision center. I saw three different Aston Martins between my drop off and pickup! I also saw a BMW Z8 which was getting some work as well. Per the accident, they ended up replacing my rear door, fixing my front door, replacing the mirror, door handles, and a broken lock actuator in the rear door and painting the whole side of the car. Additionally I went ahead and paid to have them repaint the front bumper since there were four years of highway rash which was starting to bother me. There was a delay with the insurance on supplemental items such as new weather stripping and door trim pieces, but, the items were replaced. I picked up my car Friday in a pouring monsoon which was fitting, because that how the weather was when I originally took delivery.

I can't recommend the folks at Katy Coach Works enough; they were polite, professional, and treated my car as well as the high dollar rides they were servicing. I was appreciative that when I stopped by for a surprise visit, they showed me my car as a work in process and explained all that they were doing. This helped ease my concerns. If anyone in the Houston area needs a body shop, this is the only place I would take my car!

So far I have not heard from my insurance on if they will go after the other party or not. My deductible is only $200, but, I'm more concerned with an increase in my premium renewal in september. I did receive a letter from the ladies insurance that I have a statue of limitations of one year for small claims court. I'm just happy to have my car back, I was stuck in a corolla for the duration of the repair and it was damaging for my self esteem. Luckily, having my car back and some good driving will heal these mental scars!
