New tranny @ 41K miles? WTF!

Hey guys-

I have an 06 330i that I purchased with 25K miles on it 3.5 years ago. I travel a lot, and as such I have only put 16K miles on it. In the past 8 months, I've had a failed engine coil and now that are saying I need a whole new transmission. The car was really notchy between 2-3 gear, and they are saying the whole tranny is dead. W.T.F. Of course, the warranty is out. Any ideas on what I can do? Anyone ever heard of an issue like this on such a low mileage e90? This smells like a lemon to me, but since the warranty is out, I'm screwed on the lemon laws.

Thanks!

Someone threw out a phone number a person higher up at bmw na, might try that (in the f10 thread) explain you want to have brand loyalty, but something like this only exasperates your concerns about future purchases.

(think the thread was psydocs ac)

My bet the best you'll get is half a good will split from NA (if your lucky)

Be nice your at their mercy now.

Assuming it is an automatic gear box. One of my coworkers had his slashbox replaced at 35K miles in 08 e92 335. He got lucky it was still under the original warranty.

I don't think "lemon laws" would apply to a used car anywhere.

It could be possible to destroy a manual gearbox in 41,000 miles but you'd really need to work at it. What do you know about the Evil Previous Owner?

Have you considered a used transmission?

I don't think "notchy" (OP's post) usually describes an auto box

I'm not sure they're saying the whole tranny is dead so much as you maybe have a bad 3rd gear synchro, and I think typical procedure these days is to just replace the transmission with a remanufactured one one rather than having the dealer tear the thing down and fix it, which they won't have a lot of experience doing.

My original transmission was having issues so it was replaced, and the new one also feels like a total piece of junk to me. Never experienced a transmission that's so prone to balking, binding, and grinding so often in anything less than tropical temperatures, and if it's not handled carefully, and I've never been able to get a resolution.

A transmission certainly shouldn't be failing like that at such low mileage but it's always possible there was something not 100% about it when it was built, or that the first owner was rough on it. Depending on how long it's been out of warranty you may or may not have any luck getting some help on the repair, though it can't hurt to ask. It would probably make sense to also see what a used replacement tranny would cost so you can weigh your options and decide if it's worth fixing at this point or not. Hope things work out for you.

They need to race the trans, because BMW doesn't offer replacement components other than seals and a few misc items.
It's likely the wear or failure of just one part, but you need the whole trans.

Call it bad luck, you just don't read about transmission failures, at such a low mileage, anymore. Worst case scenario is ~7k at the dealer. Which means that a good Indy can throw it in for around 4k parts and labor. Keep us posted with the outcome, final cost....

The ZF are prone to external leaks... maybe the previous owner didn't care and the transmission ran out of oil for a while.

Lemons don't usually make it 6 years, I'm guess previous owner raced it. That's why used cars are sometime horrible.

so BMW USA has offered to pay 1/3 of the cost to replace the transmission. Trying to work out a deal with the dealership to take it off my hands and get me into something else. We shall see - thanks for the feedback everyone.

Good move and the "discount" is a joke as you'd still get saddled with 5k.

Why do you say it's a joke?

Is your car a manual or automatic transmission?
