Dealer Allocation Flexibility??

I understand that ED normally bypasses a dealer's allocation of a model, but that can be suspended for high-demand cars. Unfortunately, I have my eye on a 2013 M6, and others have said that's the case: any EDs right now come out of the dealer allocation.

So here's my question: A dealer just told me "we were only allocated 2, and we've sold them already for $5k over MSRP. But, we can sell you one and have it available for ED by January."

Huh? Doesn't that go against the whole concept of "allocation"? Would they be taking the very large profit and buying allocation from another dealer? Or can they indeed pressure BMWNA to give them more cars if they show sales? Or are they just betting that they may be able to get one, but it's no big loss if they later tell me "sorry, couldn't get it"?

They are either banking on getting another one, or have a line on one they can buy.
