high clutch

hello all
i just got a 09 cop z4 35i and the clutch feels like it is grabbing at the top of the throw. also i get a funny smell when shifting into seccond when the rpm are over 5k.
the car has 30k on it and is under the factorey warentee still .
is my clutch gone?

Yes your clutch is worn out. That smell is the slipping when you dump the clutch. The factory warranty should cover it.

They may say the clutch has been abused and not cover it.
