I wish you good luck in all this crap OP. Stuff like this is exactly why I won't buy a used luxury car ever.

What about all the brand new lemon BMW's, especially recently?

Atleast a used car is somewhat proven....

Lets keep this on topic for the OP...he deserves at least that much.

I guess if an outdated M5 makes you happy, good for you. Rest of us can afford new cars every couple years and will continue to only buy new (997.2 Turbo S PDK is my exception)

And what rattles?

I'm curious since I recently took ownership of an X5 and the Carfax was fairly clean, CPO and a lease return to the BMW dealership I got it from. I would think even dealers are capable of these types of shenanigans.

And I hear you about not wanting the wife and kids in an unsafe car. Sorry for your hassles.
Carfax only tells you what it knows, just like NICB. Cars like this could have been bought by a shady body shop for peanuts, "fixed" and resold. I know of body shops that have their own used car lots. I also know of a body shop that owns a junk yard, which is really scary.

This means nothing. Tons of luxury car owners who get sick of them falling apart trade them in, so other people can be stuck with them. Used cars aren't more proven. In fact, If you buy it new, then at least you have a chance to lemon it. Can't do that with a used car.
