Doesn't seem too out of the ordinary given what I see on e46 forum and I'm not sure if fluid changes would have avoided or helped. I'm not sure what the symptoms are or if the fluid has been changed before, but if it were my car I would do a fluid change or two back to back to see if it helps.
If it doesn't and the car is falling apart in other areas I would donate it or sell off cheap. If it's in general good condition and I needed a little more time out of it or get more money for it I would try a used transmission from a BMW dismantler. The good ones will offer a warranty on the part, you're on your own for labor.

Not really too many symptoms. We noticed shifting weird the other morning. Then on her way home the tranny fail safe mode then started stalling on her. She had to put it in manual to get it home.

I don't think she has ever had the tranny serviced. She bought it 3 years ago with around 110, 000 miles on it.

I did read up in the X5 forum. Sounds like what you said to do. Fluids change...maybe a mechtronics sleeve and or seal???? Just wanted to see what my 6er folks have to say. Everyone seems a little more knowledgeable amd helpful in this forum.
