My purchase contract?

Not sure if this is the correct forum to post regarding the purchase contract on our o4 X3 but, Ive tried to resolve this when I first got the car with no luck. Its now over a year and I have to find out if I was ripped off as badly as I think i have been?

Does anyone know who I can talk to or show my paperwork to and get some answers?

One quick question: When you are on a dealers site looking at used cars online and you find one click on the picture etc. You make an inquiry on that car via email with flyer attached. Set up an appointment with salesman, arrive to meet the guy, see the actual email printed out on his little desk. If that car was listed at $13998, why on the sales contract why do I see "cash price of $15632? I called the manager and ask him why he charged us $15632. when he had it listed at $13998.? He says there are numerous reasons why the price would be higher, your credit bla bla. A bunch of BS is all he could come up with. I called the same dealership but on the other side of town and posed as someone interested in one of their cars, ask the same question, this guy said, you would get that car for that price that is listed, period. I knew it but they werent hearing me, Id call and they would just leave me on hold.

Why did he change the price? He also listed us as walk ins, we werent? They also set us up with a crooked insurance company as well. We purchased full coverage which debited 289.? buck straight out of my bank but on the contract doesnt show us having insurance. Then while husband was signing paperwork (I knew we were getting screwed) The salesman ignored me completely and kept saying just sign here John. Anyway, He tells us we have to buy GAP insurance, I said why? We went back and forth, nothing resolved. We get home and I start reading the contract, I see the $500 charge for the GAP. Call finance company and they acted like I was speaking in hebrew, didnt connect the dots. After hours back and forth again, I got no answers.
One last thing, somehow I ended up with the original quote that the lender faxed over to the dealership with all the details of the loan, on the very bottom I see this little note saying something about deferred payments, if this was the case, it had to be disclosed.
Well, Traded my car in + they wanted another $1500 = $2500 down. The $1500 was deferred but on the contract it shows we paid them a cash payment. The guy even tells Johnny, When the bank calls you and ask you about the down payment, tell them you put $1500 cash down. Sure enough, they called and ask and Johnny told them he had.

I have the paper where the salesman worked out the payments with dates on the back of that quote from the bank.
The worse part of all of this, my husband is paying 23% interest with a $545.00 monthly payment. IVE BEEN SICK SENSE HE DID IT. Kind of like the towing story! We had just got screwed on the PT Cruiser and needed a different car, so again, he signed without listening or reading sht. As usual I have to try and clean up the freaking mess every damn time.

Is there anything I can do. We have paid for over a year on that car only late once if that and the other day I looked at his credit report and it shows he owes almot 20k. OMG.ARE YOU KIDDING ME............. WTF

I wouldn't trust the credit report payoff. I would call the finance company or see if they have a website. If everything was in writing you're probably stuck. If you have a 23% interest rate I'm assuming you have bad credit so refinancing is out. So your only option is pay, on time, every single month, and be sure to keep good records. If you haven't already...... tell them you need paper statements. That way you'll have a hardcopy record of your payoff progress.

Running a generic value on Edmunds it looks to be worth about $7,000.00 private party so she would have to pay big to get rid of it.

During my Army days I had to deal with this very situation many, many, times with my new soldiers getting caught up by the "easy financing for active duty" car lots right outside the gate. Unfortunately these things usually don't end well. You get stuck with a worn out old POS that oftentimes has a salvage title and is always priced way over what it's worth. The military has the power to put these places on the "Off Limits List" if they are too bad so I had more clout than what this lady has.

Ahh yes, the "Off Limits" List. One that was avidly awaited each month when the Naval District Commandant issued his list for the area. The sailors called it the "Liberty List" -- but of course they were not thinking of used car lots.
Leeann perhaps there is a legal aid society you can get some help from. These slicky guys thrive in the dark and are loath to have the light of attention focused on them. A well crafted letter from a lawyer might have the effect of getting some sort of buy back agreement. If you are lucky, the next time -- go to a place other than that one on the outskirts of town with the dusty plastic flags and the salesman wearing snakeskin boots. Good luck!:angel:

I hate slick operators like that, but in the final analysis: Caveat Emptor.
No one was forcing you (or your husband) to sign that contract. If you knew in advance they changed the price on you and you knew you'd be charged an outrageous interest rate, and if you knew how to communicate and read in English, then why in the world would you have agreed to such an arrangement? If they popped the price up on me like that, I would have turned around and headed out the door immediately.
If you found out about all this a week or so after buying the vehicle, you may be able to make some noise and do something about it, but you've had this car for a whole year, and now you're trying to clean things up???
I don't want to sound mean, but your problem started with your husband who entered into a major transaction without regard to the problems that were evident from the beginning. Sounds like he has a history of doing things like this.
At this point, it sounds like you're limited to filing a report with the BBB or reporting their unethical business practices to the Attorney General's office but I doubt you'll get any real relief from those sources. If you had moved more quickly, they may have pressured the seller to rescind the contract but I'm afraid it's way too late now.

No, I made noise but John had just wrecked m Cruiser( that was paid off) I paid cash for it right after a huge win at the casino. =( He rear ended someone and messed up the grill and other things so the values went from good to crap soon afterwards. Every time Id say something while this was going on, the salesman straight up lied to me. Love my hubby but unfortunately he has that passive personality, don't even question their integrity. they are car salesmen after all trust them. RUKIDDING ME.. need to find a therapist for him and me as well, if he keeps making bad decisions.. lol. not really funny. I didn't notice the price change until a few days later going over the contract, and I did contact them, I acted like I was looking for a car and called them and specifically ask them why would they change the price of a vehicle that was clearly shown as ..... could they? nononono. from everyone I talked to. Called the manager and he goes into the BS saying well there are certain times when the price is affected ie..bad credit trade in??? blah blah blah. I said nonono I wasn't talking about the interest rate.... the sale price that's showing online for that car. which at the time was 13,980, 79k miles one owner ( so he said0. They put us down as walkins..... and so many other things went south,,, I didn't sign, he did,, that's why I wasn't being heard. Your probably right about not getting much done at this point but when I found that car I didn't realize what all it didn't have compared to other ones like it. I feel sick every time I think about it.... and get pissed quickly at .. all over again. Its not often that I get taken advantage of and when I do, I seek revenge at all costs,,, so, when I realized I was getting nowhere fast with that guy I hung up and read that contract over and over until I understood it fully. John was talking about the additional down payment they wanted from him 2wk 500/ 1500 . somehow the price sheet that they use to submit to the bank they use to finance ended up in our paperwork -) couldn't believe it... Im reading this thing and notice in small print ..... all deferred payments must shown and listed on all purchase contracts , a requirement before loan would be approved. Then Johnny tells me that right before we leave the guys tells him that when the bank calls him and ask him if he paid a cash down payment to say yes. I looked at the contract again and its showing we paid 2000 cash and 1000 trade in,,,, traded PT for 1k and was suppose to make payments for the other over the next 4weeks.
that's when it clicked, He upped the cars price to 16k something then tried to get another 2k in his pocket by making the bank think we paid the full down payment. He called every other day.... where is your payment.... we are coming to get the car,,,, I said good luck with that,.,,Im not paying you another cent we are paid up. don't you remember what you told John to tell the bank... read your contract ......... click.. I got some of it back lol........... that was long sorry,,,, the same guy still manages it too... lol its a nice dealership crazy... no offense but a bunch of home boys with their family members are
running it.... good possibility lol............they still won for what we have actually paid at 543 a month for almost 2 yrs,,,,,,:bawling:, that's why I will never sell that car I have to cherry it out no matter what and keep her :drive::drive:THANKS

All banks and finance companies have a compliance department hot-line to handle fraud. You can call the bank (there should be a phone number on your loan agreement), ask for their compliance department and tell them that you want to report a fraud.

Now, the wrinkle is that your husband did commit bank fraud (18 U.S. Code §1344) when he lied to the bank, and he did it on the phone which makes it wire fraud (18 U.S. Code §1343), both of which are federal felonies. He could get up to 30 years for one and 20 for the other -- plus a million dollar fine. The only reason why the bank would go after your husband is if they are in cahoots with the dealership. I've never had a bank call to ask if I actually made a down payment, so I'm wondering if they did that to entrap your husband into committing fraud -- because up until the phone call he had not. It may be some sneaky way to keep people from defaulting -- if you stop making payments the bank suddenly "discovers" the fraud. That's a pretty wild theory -- it's far more likely that the dealership is ripping off the bank, but I try to cover all the angles :)

So if you call the bank, do it from a pay phone and don't give them your name unless they agree not to press charges. If they want to go after the dealership they can do it based on an anonymous tip, but it's better to have a witness.
