TopDown have you pulled the service records on your car and was the top issue something that was going on before you bought your car or did it start after you purchased the car.

No - the lemon law only applies to the first two years after original purchase.

Picked up my car last week. It didn't last 2 days! In the last 2 months I've had the car less than 2 weeks. I guess it will never work!

That is ridiculous! didn't the dealer put the top through a ridorous test before handing it back to you? Man that really sucks. At this point I would be really, really pissed. The focal point of the car is the convertible top and to think that the damn thing don't even work for half the time, is really a joke and really reflects bad on BMW. I have my eye out for a newer one but have this stuck in the back of my mind about the top issue. Not a good thing. What is your next course of action?

UPDATE: Another regional rep came and looked at my car today. BMWNA is going to replace the entire roof. Parts come in next week so I'll be posting to this thread once the work's done.

They replaced my entire roof and within 2 days its broken again! They have had it all week and still can't fix it. I hope it works better for you.

Oh geez... that's not good. My interior lining was like $6K and the rest of the roof is like $13K... you'd think it would fix it.


The good news for your new roof is it comes with a 2 year (no mile limitation) warranty. Keep bitching...

Wel that is good news! Well, sort of. But atleast you will be getting a new roof. You should not have to be going through this in the first place. Keep the fingers cross and hope you are one of the luckly ones.

Wow this doesn't sound good. At what point do you get a lawyer and start some action at getting a buyback even if your outside the lemon law period.

I wish I knew what to do. BMWNA has not contacted me so I guess I'll have to find other avenues.

I don't know when I will reach the point of legal action. I didn't buy this car from a dealer, I actually bought it from BMW lease return auction. I'm a car dealer so I am quite aware of the what recourse I can take advantage of. I hope BMWNA will contact me to disscuss my situation.

UPDATE: Got my car back today with a fully replaced top. Looks fantastic and is working well so far. No sign of the dreaded "top not locked" but I'll keep you all posted.

Thanks a ton. The great news is that normally since I'm under CPO at this point, the top wouldn't normally be covered. Since the problem had been happening since before the original warranty expired, it was covered. Now I have (in addition to another year on my CPO warranty) 2 years warranty on the top!

Fatal Top Not Locked Issue

Well ladies and gents.

It happened again today. The Top Not Locked Alarm went off. I went into the dealership for the 16th official time on this issue.

That pretty much did it for me. I walked across the street and bought a new Infiinity G37S retractable hard top. Black, 328 hp, iPhone and Nav, windscreen, sat HD radio, sport package and manual transmission 6 speed.

$1000 less per month than my BMW payment.

I still have the 650, but will turn it in in two months. Thank God I did not buy the thing or I would never be able to sell it for the residual with this "Top Not Locked" issue. Or I would have to get the sensors/cables re-aligned for winter cold weather....and then just lie to the new buyer and let them be surprised come the June timeframe. But I could not do that to another human being. And I should not have had to put up with this on a 3 year $45,000 depreciation schedule car lease. Just should not have had to put up with this.

Maybe again someday. But right now I just cannot take this any longer. Had to bail.

OK, so after my second time at the BMW dealership the top still has the error... I called the adviser and they want my car for the week. I've been directing the adviser to look over these threads so that we all stop wasting time.
BMWNA has to step up and work with all of us on this issue, it's not chatter when you have this many people with the same exact problem over and over and over... I have to drive 3 hours each way when I need to see the dealer. Needless to say I don't want to visit the BMW dealer every other week.

Another thing that bothered me was the salesperson's insistence that I must take a BMW which was a color I did not like, upholstery which I did not want (at a $2400 premium), and which did not have the sport package, because there were only 6 or 7 650's left in the Southeast US on the online inventory. The closest to what I wanted was in Florida. But it was not really what I wanted either. But of course I HAD to have a BMW as he stressed, even if it was not what I wanted exactly.

This is baloney.

Infinity had what I wanted, right on the lot. The salesperson was deferential and personable, and gave me a fabulous deal right off the bat...He did NOT want to sell me the tire package, did NOT want me to prepay my maintenance, did NOT want to offer a package of accessories for 6,000 additional. The iPhone interface and windscreen were already included and fully functional.

Overall it was a great experience, and I jumped on it because they had exactly what I wanted, right there on the lot. I drove off the lot and got looks from 3 ladies just on the drive home.

I am not paying this price for a car to get something which I have to settle for, just because it is a BMW, or I was hustled, or there is limited supply of them left in the US.

Anyway, enough rambling from me.

Nice! Everyone encounters that bad salesman too often that's why it's priceless to find that one you can trust and keep going back for help.
