Well - I had an accident last week when I was merging into the left lane. Thankfully no was hurt but I'll be w/o her for approx. 3 weeks. Although the other guy was speeding (I wasn't for a change and isn't that ironic!) I'll most likely be unable to prove it. Here in SoCal, the police don't come out for non-injury accidents so there's no official police record.
Insurance adjuster working with Autowerks repair facility has estimate starting @ $13K depending upon what else they find while breaking the car down.
Looks like I'll be getting my money's worth from my insurance but expect I'll have to switch to a new insurer cause I know they're going to raise my premium. Got a Chrysler 200 convertible loaner right now but may rethink cause my rental insurance tops out @ $1,500 and can't be sure how long the repair will take...
Damn sorry to hear/see! You are one of the F10 Pioneers around here. Glad you were not injured. Anyway, I hope that the repair work is started/completed in a timely fashion.
If the other person was speeding, why would you change lanes into them? Dude, if I see someone speeding, I let them go. Unless they told you they were speeding?
A similar thing happened to me 20 years ago, except I was the one going straight. It was at a low speed (the other car was stopped at the light). The police showed up, and the other party was cited for unsafe lane change, from memory. They said I was speeding (I'm not sure - but probably not, since it was a red light that just turned green, plus other folks on the scene gave me their contacts as witnesses). The car was written off, since the impact pushed me into the traffic light head on. End of story - she didn't have insurance, young driver, and after years, she settled with the insurance company just before it was going before arbitration, literally minutes before I and the policeman were to make a deposition with the lawyers.
I live in SoCal too and my wife's SUV was recently rear ended at a red light (by a university student in her Ford Explorer, traveling around 10-15 MPH, not paying attention and texting, etc....) My 7 year old daughter was in the car and thankfully no one was hurt. I still am even more thankful that my other kids weren't in the car, especially if they were seated in the 3rd row seat.
I too learned that in CA they don't send the police out to write a report if no one is injured. I guess this was such an obvious fault by the other driver that even my State Farm people told us to go after the other insurance company first on our own to see if they would pay it all and if any problems they would take care of it. State Farm would even push to get my deductable paid if I had to pay out of pocket first.
Surprisingly the other insurance company did pay up and paid quickly covering the repairs and rental car during that time, so 2 weeks without the SUV and driving around in the weirdest rental vehicle ever (New Dodge Nitro) all is now complete and paid up.
I still don't quite understand this no fault CA Policy since it's could turn out to be a he said / she said account without a police report. But maybe if the other driver owns up to it and states fault, then it's covered.
