For all those who say its me and not the car...

I know that I am the one going fast.. I agree to that and for a while now I do need to hold back a little..

My point is that at least 10 cars around me was doing the same speed... why pick me? that was the point..

My driving habits have not changed much from my previous car... In my neon I was doing the same speed ranges and I only got 1 speeding ticket in 4 years..

In the Bimmer, I'm doing the same speed.. on the same roads.. but now it is with ease.. doesn't feel as fast.. and gets more attention

Thanks for all of those who gave me support.. I love this forum...

Yes, it does attract attention to be driving the BMW.

That's why I try to stay below the average flow speed. Yes, at times you feel stupid and it does feel unsafe when people swerve to avoid you and give you the finger on the way by.

But that's the way it is.

I got 2nd speeding ticket is 7 years 1 week after I got the BMW.

I wonder what'll happen to me when I get the Evo?

A police officer cant really see the difference between a BMW from a Pontiac from 100 yds going 80 MPH. It could be color, following distance, or even chance. Im not hating on you for speeding, but there are ways to make yourself less visible. We discuss this a lot around here. If you search you will even see what police officers look for posted by a CHP officer. And it usually relates to what lane you drive in or if they think you are being aggressive.

well in traffic school 100MPH+ is Wreckless (or is it reckless?) driving and i know that for a fact. My traffic school teacher (ex-cop) told me that and my FRIEND was arrested at 115MPH. Also it is 2points on record.

And the numbers i gave you came from a santa clara county police officer and i also said "it can" be taken into consideration as reckless driving.

Next time you see a cop, put your tail between your legs, drop to no faster then 4mph over the limit and get your ass in the right lane, pronto! If you don't your risk of getting a ticket goes up 10 times.

That's not the point. I don't think the subject of the post is "Why do I get a speeding ticket when I speed" but more like "Why do I get a speeding ticket when my speed is equal to that of traffic flowing around me".

And to this second question I think we can discuss if the car itself attracts the attention of law enforcement.

Which is why I posted that I tend to stay a couple of MPH below the average traffic flow...

I think you may be confusing the law with traffic school platitudes, or rules of thumb that cops might follow in deciding how to write a ticket.

There is nothing in the law about 100 mph being a magic cutoff for reckless (wreckful? ) driving. There are higher penalties in the law for driving over 100mph (higher fine, possible license suspension) than regular speeding below 100mph, and maybe that's what the police officer was referring to, but it's still just a speeding ticket, designated an "infraction." You can't go to jail for an infraction. Reckless driving is a misdemeanor, for which you can be sentenced to 90 days in jail, in addition to fines.

There may be police officers who have a policy of citing people for reckless driving if they're driving over a certain speed, but that's not the law. No self respecting District Attorney would charge someone with reckless driving for driving a safe vehicle 110 mph on an empty limited access freeway. And, if they did, a judge or jury would still have to find beyond a reasonable doubt that the person charged exhibited a willful or wanton disregard for other people or property in order to be found guilty.

I don't disagree that driving over 100mph increases your legal peril, but it doesn't, by itself, constitute reckless driving.

Reckless = Heedless or careless. This is what you want to use when describing 100+MPH driving on streets.
Wreckless is not a word. But the two parts Wreck less would mean without an accident or wreck.

I feel the same way gang! I believe its more of en attitude that anything else.

For instance I got nailed yesterday, aghhhhh! doing 52 on a 35mph, 3mph more that would have been reckless driving which gives 6 points vs 4 points, on top of my already two tickets previous 8 mos. My previous 2 tickets were:
a. 43mph on a 35mpg and the other was (4pts)
b. 49mph on a 25mph (6pts)
... knowing that that was going hurt me with insurance, i went ahead and enrolled myself with DMVs drivers ed program to get 5 pts credits back, instead of being told by the courts on court day.
For if i am told if Im told to enroll by the courts, the credits of those classes dont apply.

so I was sitting pretty on 5pts on my record before yesterday, now will soon have 9 pts on the records. I unless my contest of just following traffice flow flies.

I am thinking of maybe getting another license from my home state NJ. I wonder how that work, living a Va having a NJ license. help!?

so now! I put on my cruise control everytime I drive and just learn how to drive like an old lady. The funny thing is, I wasnt driving a BMW in any of this incidents, maybe its my BMW hard drving attitude that earn me these points. I do confess, that the bimmer made me a little cocky my driving habits. And if yur driving an M, forget it! its a double whamming, for its hard to keep the under under 25mph and its also hard to let it rip and sustain it without being caught. Which is worst? lolz aghh!

So, its not the car, its the attitude gang!
