Yeh - I think I need to talk to the insurance company again. I was definitely stationary - although I did pull in front of him but had time to stop and use an expletive befor he hit me.

Not only completely stationary - I had time to stop and was out of first and halfway to reverse!

No - he was going straight through the light?
What you see there is the kurb - the corner - he pushed me from the middle of the intersection to there - the picture is a little deceiving. Therre was still quite a bit of room between his car and the curb. When I backed off and moved he drove straight through to move.

Wayne!!!!!!!!!!!! What a bummer. I feel some attachment to your baby since I was there at the "birth-ing". I still have the picture of our babies sitting side by side in the ED center in Munchen. I feel for you. I think I'll pop out to the garage and make sure my baby is tucked in for the night.

Seriously, glad to see that you are ok, and I hope you can get thru the insurance and repair hassle in record time.

MAJOR WARNING, I went through this...

The pictures you are seeing are form two separate crashes. The first one happened in December of 2004 and it was very minimal compared to the second one depicted in the other four pictures which happened just this month (Feb 06).

Now there is a huge difference between the front and back of the E60 and the E90, in that the E60's front and back are made of aluminum and are glued on to the main frame. This prevents the main frame and the door seams from being altered or bent even in the worst crashes. For this very same reason my insurance company estimated the repairs to cost around 7K and to take one month. Over 9 months later and after over 25K of repairs, I got my car back (after numerous fights and conflicts of course) and it still was not perfect. it was not even ok, let alone perfect.

So when it crashed this time and they just estimated the repairs to be at 12K, (with the engine having broken into pieces) I had had it. I presented all the facts from last year, and finally got them to pay off the whole remaining balance on the car declaring it a total loss.

The point is that, even though the E90 might be more "totalable" due to the lower price, and the uniform steel frame which can be bent in heavy impacts, you still DO NOT WANT to have it repaired. It just takes too long and never EVER gets the car back in the shape it was even though the world will promise you that initially.

So, please do not hesitate to push them to toal it. It makes a huge difference if you breathe down their neck every day than if you let them do "their job" or at least what they think their job is. If you want justice and a tight slient BMW, get pro active and make them total it.

Glad you are OK. And please, do yourself a favor...make sure the dealer fully tests the airbags and provide an explanation as to why they weren't deployed in this accident. You need to make sure they are working!!!

The point is that, even though the E90 might be more "totalable" due to the lower price, and the uniform steel frame which can be bent in heavy impacts, you still DO NOT WANT to have it repaired. It just takes too long and never EVER gets the car back in the shape it was even though the world will promise you that initially.

So, please do not hesitate to push them to toal it. It makes a huge difference if you breathe down their neck every day than if you let them do "their job" or at least what they think their job is. If you want justice and a tight slient BMW, get pro active and make them total it.

He was hit from the side while he was stationary. Thus, deploying the airbags wouldnt do much good. I'm guessing it is not a malfunction, but instead the computer realized airbags were not needed in this accident.
