What happens to MSD if you wreck the car?

If a lease is wrecked but it is not totaled and there is diminished value due to the vehicle being in an accident, can BMW keep all or part of your MSDs because of this? I assume if the car is totaled they have to give them all back. I'm just wondering if anyone has been burned with MSD other than BMW keeping part of them for valid reasons such as damage to the car beyond what is covered by the regular security deposit, etc.

I know you lose any down payment on the lease (cast cop reduction). That's one reason it's a horrible idea to do that on a lease.

From what I understand you get the MSDs back.

if you total the car, the insurance and gap insurance makes bmwfs whole and you get your MSDs back.

if you wreck the car and get it repaired according to BMW guidelines (as per your lease return guidelines, authorized bmw repair center, etc) they wont penalize you and you'll get your MSDs back. there is no clause in the lease about diminished value. just that the car be repaired to their standards.

if you wreck the car, get substandard repairs done, they will bill you, MSDs or not. the only difference is, with the MSDs they deduct the amount from the money they return, without, you'll get a bill in the mail.

the only time you will get dinged on an MSDs return is if you have chargeable violations of the lease return guidelines. like worn tires, un- or improperly repaired body damage, cracked windshield, etc. but if you didn't do MSDs, you would be billed for it anyway.
