So, the day starts out fabulously...found a great volunteer gig in the Cook Islands (10k miles from nowhere in the Pacific) that leaves this coming Monday. Go to Doctors to get all my shots, no problemo. Heading home on a surface street in Somerville, one of Boston's urban suburbs, maybe going 30 (if that as its a busy, narrow road). Guy in a 2008 Acura blows thru his stop sign and pulls right out in front of me. I immediately slam on the brakes, but the antilocks don't stand a chance. I swerve, hit him, then we skid into a parked car.

Driver is a firefighter, so Police, fire, ambulance called, the whole shebang. Airbags did not deploy...I am shaken up and sore, but nothing broken. Police said it was pretty cut and tried, he's at fault since he had the stop sign. Car starts and moves forward, but it leaking coolant and the engine light is on. Cannot turn wheel more than an inch, otherwise the tires start to rub. Front is pretty smashed up, hood totalled, radiator pushed back into the engine bay, wiper fluid resevoir scrunched, bumper/fogs/lights in pieces. By the time all the officials were gone, it was getting dark, didn't get many pics. The pictures actually minimize than the actual damage (at least to my untrained eye)...

Towed to my guy who just did all the suspension work. He understands how rare of a car it is and will work with the adjuster to make sure I get credit for the freakin' 2k I just put into the car...that doesn't even count the 1k of parts/work that CJ did, plus the $1k from post PPI. I need to clear $14k to break even. From the year and model, I think it might get totalled and I'm gonna get screwed.

Plus, I'm supposed to leave Sunday for a 20 hour flight across the Pacific. I think I may not go (luckily, I was buying the tix tonight) concerned about deep vein thrombosis 10k away from a decent hospital (and trust me, I'm not overly crazy here...they used a gurney to wheel an unresponsive girl off of my Minneapolis flight...after she had been in a car accident the day prior to our measley 3 hour flight).

I think I'm in shock. After all that freakin work to find and polish up that car.

EDIT: I know I should be grateful that I'm fine...my brother was not so lucky. But I worked hard on the snowmobile...and it's awfully late in the season to start looking again!

So sorry to see this Jen! All you can really do now is sit back and hope the insurance turns out in your favor. If I had to guess, I would say it isn't totaled. It's a tough call. At least you're ok, though. That's the important part.

Awww.

This might not be so bad though. I'm pretty sure it will be totaled, but you can buy it back and turn it into a dedicated track grocery getter.

My words of advice:

A. EVERYTHING IS NEGOTIABLE, no matter what they say. The adjuster has a ton of files just like yours and gets hounded to move them quickly. If that means paying a bit more, they will. Doesn't hurt to tell him you expected more and will have to think about it no matter what the offer. Then make him wait a bit. Let him call back and make you a better offer, then negotiate that.

B. All maintenance in the past x months depending on state is reimbursable at face value. That means any upgrades you did are not reimbursable if they're upgrades, but are if they're needed repairs. Everything you've done was a needed repair, right? Wink wink.

C. Have them break down the value of the car and the repair reimbursement separately so they don't try to cut you out of some money.

D. Extol the little features of your car that set it apart to no end to the adjuster when they come look at it. Emphasize factory options over aftermarket upgrades. Polish it up and vacuum before the adjuster comes out.

E. Find out if they are assigning any additional value to upgrades like the wheels. If not, buy the cheapest you can on CL and swap them out if you give up the car. Same with any other upgrades that you can't get full reimbursement for.

F. Find out the buyback price after they've made you an offer and strongly consider it.

G. Open a bodily injury claim immediately, even if you end up not needing it you can always close it. Better to have it open up front. Don't settle this for at least 6 months to make sure soft tissue damage and whiplash don't set in.

Damn Jen! Glad you're OK! The sheet metal looks bad but it may not be as bad as you think. Unless there's a defect in the SRS the airbags not activating is an indicator of relatively low peak force. I know it probably didn't feel that way though! Probably the right decision not to make the trip. I got hit in a rear end accident some years ago that totaled my car. I think the adrenaline from the accident delayed the feeling of the injury because I felt fine that day but the next day I could hardly get out of bed.

Chad....thanks for the detailed info. VERY helpful. One more question, with whom do I open an injury claim? I called my insurance company to start the auto claim and I did tell them I was sore. Do I call the owner's insurance company for the medical???? Or do I call my own medical insurance company? I've never had this happen.

Hell, if it does get totalled, maybe I'll buy an auto and do an engine/6 speed swap...or maybe that e46M3 that Joey said we could fry an egg on

The more pressing question is do I delay my volunteer trip? Once I leave, I'm gone for at least a month with little to no cell reception. How long do these settlements take?

glad you're ok, though. i think chad has some very good advice. it may be close to being totaled, but that does look to be repairable.

i'd consider a buyback as well.

Your insurance. If you told them you were sore they likely opened one, but it never hurts to check. Insurance always separates property claims from BI (bodily injury) and typically you'll have separate adjusters for each.

Will go into some more detail on any questions in a bit when I'm home.

I think MA is a no fault state so it's likely your PIP covers your medical up to a certain $$ amount. You file a a claim for any medical bills with your insurance company. If you declined any treatment at the accident scene you should go see you doctor first thing and get anything that doesn't feel 100% ok documented. The doctor may not find anything but you've established a medical record that will list your complaint if you need it at a later date. You send the bill for the exam and any following related costs to your insurance company for reimbursement. Keep in mind that anything you do that is indication of normal routine or activity over the next few days will work against you if any legal action is required.

Thanks guys. I honestly didn't hurt when the accident happened...but it's beeen getting worse as the night goes on. Right side of Neck is sore, right shoulder blade area is sore, and my right hip are all sore. There was no way I was gonna brave a Boston ER, but Don, what you are saying makes sense. I will go into my doctor tomorrow.

I don't think I'll be able to leave Sunday. It was gonna be a tight squeeze anyways, but with now all the accident stuff, I don't think there is gonna be time :-(

This is adrenaline reaction. It's fight or flight body response to danger. Your body releases a huge shot of adr so you can react but it takes a while to metabolize out of your system. Once it does the pain endorphins are released and that's when you feel the injury. Definitely get to the doc first thing in the morning.

Jen, that's awful. I am so sorry! I was just showing a picture of your car to a friend today, telling him how rare and nice it is.

I'd strongly suggest contacting a personal injury lawyer, but see the doctor FIRST and document EVERY ache and pain with him. You want all of it on record as fast as possible.
