Bought a demo 328 and turned out had an accident

we bougth a month ago 2009 328i sedan with 6000 miles on it at a bMW dealership. Titled as new. It has already been in the shop 3 times for 16 days. We have had multiple problems with the car. I took it to Car Max to get it appraised and evaluated. Turned out that the car had the left fender replaced from a prior accient. This was never disclosed when we bought the car and it lowered the appraisal by several thousand dollars. The dealer who sold the car denies anything ever happending to the car though anyone can see to the naked eye that the fender has been replaced. I reported the problem to BMW and have a meeting tomorrow with the dealer and see what they say.

Anyone ever have an experience liek this?

But you didn't see it when you inspected the car...

Tell the dealership to refund all your money and take the POS back, if they do not get a lawyer ASAP, BMW's customer service will not help you at all, they are worthless.
I feel your pain and anger, this seems to be becoming a trend with BMW stealerships

Read my blog and see that BMW NA and DE will do nothing for you.
Some will tell you that you should have bought a new car instead, that's just BS, when you ask the dealership if the car is "as new" and if it has been wrecked etc, they have to disclose any damage that has happened to the car, the BS that they did not know does not work, THEY have to inspect the car before they sell it. No one should have to take a New BMW to get an inspection from a independent BMW tuner.

I know carfaxes are unreliable, but I thought that they gave some guarantee if you ended up buying something that had problems or issues and they missed it in their report.

If it's got 6000 miles on it, it's definitely not new--regardless of what the dealer tells you.

Sounds like a 335i that they rebadged as a 328i to make it look reliable.

Indeed, you can take something like this to court. Take the vehicle to another dealer and ask them to take a look at it without telling them of your current situation at the other dealer. If you can get them to agree, have them put it in writing. Now you have another dealer which will back you (though after they put it in writing, get their consent to use it as evidence).

I know but it was a demo and a demo is never titled so it is considered New but it was in an accident

FWIW,I don't know about your state but in Jersey,I believe any car with 6K or more miles is considered a 'used' car demo or not.
I hope I'm wrong but I don't think there's anything you can do.

Are you talking about the line on the fender when you open the hood. You know the line that looks like it was done with a spray can! For 09 cars this is now the norm and is not a sign of a fender replacement. On certain colors, the underside of the hood, engine compartment, and trunk are no longer painted. My Lemans Blue coupe has a flat black finish to these areas and the edge of the hood and fenders where they bolt on to the car look like an edge that was done with a spray can. My neighbor just got an 09 328 coupe in black saphire and it's the same way. Also, depending on the state you are in, vehical repairs need not be disclosed until a certain dollar amount is reached. Also whey would you even trust Car Max.

the left side is way brighter then the right. and the screws are unscrewed.

I bought mine CPO with a clean CarFax report. Over the course of the next couple months, I came to find out that the car had a cracked control arm bushing, bent strut and three bent rims. A third party mechanic told me the body work was okay, but he must have run over some monster potholes. Luckily I got them items replaced under warranty and the car is all sorted out now. But it did ruin my faith in the CPO process. It's just a selling tool - they obviously don't take the time to really inspect the cars. Good luck, I hope it all works out for you.
