BMW not covering Transmission Defect

Hope someone can help me. I have 2006 M-5 36,000 Mi. I put Rd sport Springs and have 20 inch rims. The Rd sport spring maybe lowered it .5 - .75" if i remember correct. My transmission is screwed up more or less thudding into each gear. Now the dealership has agreed the transmission is messed up but is saying BMW NA will not cover it due to the springs and rims. I have had them on the car for about the last 28,000 mi. In the first 10,000 i had some smg pump or something go out. They say its not related. In any event had i been told putting springs and some rims with void out my warranty certainly would not have done it,, or bought the car. Any advice out there?

Read up on Magnusson Moss. No way are your mods related to your issue.

Ask them to put it in writing so your attorney can act on it.

You need to verify it is in fact BMWNA declining coverage. The dealer might be playing games.

Incompatible (non std) wheel sizes can have an effect on SMG operation / addaption.
