Just make sure it has "BBS" cast into the center portion of the wheel. There are lots of BBS knockoffs, and they are often indistinguishable except for that marking.

he said they were not staggered and they came off his 03 M3. Are they suppose to be staggered?

They are not OEM wheels, so staggered versus non-staggered is irrelevant. The OEM wheels for the E46 M3 were in fact staggered, but like I said, those BBS wheels did not come on any BMW from the factory, ever.

Yeah, that's the thing. They're listed at a fair price for BBS knockoffs. So, they're either fakes and the owner is lying to you (or doesn't know any better, which is entirely possible), but just so happens to be selling them for what they're actually worth, or they're real and he has no idea what he's selling, and is asking much less than their true value.

Anyway, $400 isn't a bad price for BBS knockoffs. And if they're real, you will see BBS cast into the wheel on the inside near where the center of the wheel mates to the hub, like so (just an example):
