This is just not right. I am very sorry that this has happened to your new F10. I am sure that you are very upset, but hopefully you did not get hurt. Do not let the "after" picture be the final image. Post a picture after repairs have been completed.

Ouch. Good luck with the repairs. I was within range of a swerving, texting teen on the highway the other day--'thought it was a drunk driver. Defensive driving is getting harder and harder with all of the smart phone zombies out there!

There should be strong penalties for texting and driving, and a driver ed campaign! It is so... stupid to cause an accident just because of an inane text message.

I too am sorry to see and hear of your unfortunate run-in with this Kia person. I know you must feel very upset about the new car, I would be. Hopefully you'll have it fixed so that you'll never know it happened -- best of luck with the repairs.

I saw a nice mom with her arm in a sling today. A teen ran into her 4 weeks ago, tearing her right shoulder. A police officer who witnessed the incident told her other driver faces felony charges because the teen was texting when she rear-ended her.

I carry a Blackberry for work plus my iPhone -- and both stay in my pockets while driving. Even during stop lights. I can't imaging how I'd feel running into somebody while looking down at a text.

I'm glad Massachusetts took the first step and made texting and driving illegal... I am just waiting for them to outlaw talking on the phone and driving. Unfortunately its almost impossible for a cop to catch someone texting and driving, unless it causes an accident.

I would be furious.... i dont understand how someone can hit the backend of your side like that. Same thing happened to my E60 in October, 3 days before lease turn in - you have to be completely not paying attention to hit that spot. You basically passed her already. Accidents happen, but if you manage to drive into somebody's rear corner panel its a pure matter of negligent vehicle operation and your license should be suspended.

I feel your pain

I feel your pain!!! 5 day old 535ix, M Sport with all the bells and whistles, 600 miles and a cracked windshield from a rock on the interstate. $2000 estimate from dealer with the insurance companies willing to allow on $1400!!! Trying now to negotiate 7.7 hrs labor @ $110/hr down.

This is a good start to combating this issue.. the fact is texting while driving is akin to criminal negligence and there should be punitive penalties solely above the cost of repair covered by insurance.

I would recommend a $1000 fine (paid to the damage recipient) or suspension of license until the fine is paid.
