2002 530i sport mode wont always shift

So after some research for my car i think ima go with a VANOS seals replacement, uuc pulley, and a dinan tranny software chip. My car is automatic but for fun i use the sport mode and is why i want the dinan software. The only problem is when im in 1st or 2nd gear and im trying to shift to a higher gear, it sometimes wont shift even when pressing down on the knob, i have to let go of the gas a bit so it doesn't over rev and on the second try it usually works, btw i shift a little early (around 5500 rpm) because i dont want it to over rev. Will the software help this or worsen this? Btw its only on the lower gears hasnt happened in higher gears

I dont know about the trans fluid change but I will ask my mechanic, and it has 270k miles but it has been serviced really well, burns a lot less oil than my sisters e46 328 which has like 240k, but yeah 270 is a heck ton. Could it be the transmission just being old?

BMW auto gearboxes don't normally last that long. Be thankful it's lived this long.

Oil use has nothing to do with the trans.
