Unhappy 2014 535d xDrive Lemon?

Hello, I'm new here and this post is my first. Hope you can help me with some answers.

I think my car is a Lemon and I already sent a certified letter to BMWNA, and explained everything to my assigned case manager. She said that I need to wait a week for an answer. My car was in service for 40 business days. I will post here my letter to BMWNA. Will appreciate any advice and shared experiences.

Not long after I got the car I have noticed that the car is pulling to the
right and buzzing noise in the front driver’s door. I brought the car to
the Murrays BMW of Denver dealership to be inspected and fixed. The car was
at the service department for almost two weeks, no one in the dealership
service department could figure out what was causing that. It resulted in
BMW dealership to dispatch for a specific BMW engineer to inspect the car.
He agreed that the car pulling badly but he could not identify why, so the
new sprigs were ordered from Germany because they thought that was the
problem. They said that those springs were crooked in comparison with other
springs from the same car. It took four weeks to receive them. They gave us
back our car and told us that it is ok to drive the car with the crooked
springs in the meantime. The buzzing noise was not fixed either. Buzzing
was occurring in the front driver’s door when using Bluetooth, telephone
function and radio, which forced me to take the car back into service at
another BMW dealership, Schomp BMW of Denver. It took another week for
their service department to try to fix the problem. When I picked up the
car the buzzing was still there and at this time it was louder and
occurring not only while using those functions but while driving with
Bluetooth and radio off. I took the car back and did not see it for another
two weeks. After I picked the car up for the second time, the buzzing was
still there but the Murray BMW of Denver dealership called to tell me that
the springs were in, and to bring my car for in for service, also at this
time I decided to ask Murray BMW of Denver to look in to the buzzing
problem again since the car would be at their service department anyways.
The car was there for another two weeks. I have received a call from the
service department today (6/18/2014), they have changed the springs but the
pulling is still there and they still can’t figure out what is causing
this. They also can’t fix the buzzing. At this time they still have the
car in the service department with no specific date of when it is going to
be fixed.

I am currently paying $901.02 / month for the car.

I leased 2014 BMW 535 XD which is fully loaded: M Package, Harman Kardon
Premium sound system, Premium package, Driver Assistant package, 5 Cameras,
and all these parking sensors…… All the functions and packages we chose
specifically because we use them and that are important to us.

Since the first day I brought my car to the service department, I had it
back for about a day and a half. We are currently driving a loaner car that
does not have the features we need. I do not believe that it is fair for us
to be paying this much money per month for a car that we have specifically
chosen and not drive it. Since we got the car, it has spent in service
department more time than us driving it. It is a 2014 Brand New BMW which
should not have these problems. The loaner cars do not have the options
we need and we are ending up driving them more than our car.

Again, we do not feel that it is fair for us to pay $901.02 per month to
drive a loaner car. At this point my wife and I do not feel Safe to drive
this particular car anymore, because it has been in service for more than
half of the time since we leased it. You are more than welcome to check
with both dealerships on how many times and how long it has been there.

At this time we are asking BMW to let us exchange the vehicle for same or
better BMW, or for BMW to buy this car back with full refund due to safety
concerns. We chose BMW for safety and reliability that we believed in, but
after this experience we do not feel safe driving this specific vehicle. We
do not want to drive a lemon car.

information. We will greatly appreciate your help in this matter.

Yes, they actually called me yesterday and said that the car is done and they did some manual adjustments buy hands. We came the same day and pick the car up. Drove it for 20 min, and returned for a 3rd time, because pulling still was bad, and always to the right.

What do you guys think, do I have a Lemon case?

Lemon or Lime ?

Hi Paulz,

Sorry you are having issues...

1) Pulling Right - Usually the Steering Gearbox - some are "tight" and never break in well...

2) Buzzing Noise: Soft Close Doors ? If so Torque Motor relay not dropping out... although you mentioned something about Bluetooth... if it's really coming from one of the Speakers that can be proven by disconnecting them temporarily... If really happening that way then there is a bad ground or antenna effect picking up a Hz signal somewhere - really tough to find those bad electrons although a simple Ferrite ring near the speaker input could potentially kill it...

- most likely causes from German posts... Viel Glück !

Did the dealership do a front end camber analysis and potential adjustment?

There are lawyers that specialize in Lemon law cases. Might be worth describing your experience, & see what a professional thinks. I use a site called bmwarchive.org, & sometimes I see a banner advertisement from a firm that handles your type of issue. Might be worth your while, & get some satisfaction.

get a lawyer. they may tell you to pound salt. the threat of the car being branded a lemon is not in their favor.

also document every conversation with each person from your dealership as well as BMW corporate. do not rely on any dealership "to do you favors" or "we'll call for you" type of comments.

they are not there to be your friends. make sure you get a service write-up for each visit. if they haven't given you an invoice, request--demand one.

Thank you. What do you think, in my case is it looks like a good lemon situation? Should I ask for some compensation for my inconvenience? I droped my car at two different dealerships for around 10 times for last 2 month. From 4 month I leased my car, I drove my car, for only about 2 month.

"If, within 1 year of purchasing the vehicle, every valiant effort has been made to fix the defect (and it has to be the same defect) the buyer may be able to apply the Lemon Law. Colorado statute defines "a reasonable number of attempts" as 4 attempts or a total of 30 days (not consecutive) in a shop within 1 year."

Your car was in the shop for over 30 days.

Thanks. Bmw service department called me and told me that field engineer drove the car and can't find the problem anymore and the car operating normally. And Bmw field engineer said that this bussing noise that comes from only one left driver door is normal for Bmw cars. What a BS. .. my service assistant told me him self that I should proceed with my buy back process and he wouldn't drive this car eather. He say that he's on my side.

Get that in writing. From the SA. Then press that issue to BMW NA. If the service center is on your side it should help a lot with the trade assist. STRESS that you don't feel safe in this car and you shouldn't if it keeps pulling to the right.
Make sure you document everything

Thanks. Will keep you posted. Funny thing, shop forman when he saw me leaving the shop on my Bmw couple of days ago he was joking with his co-workers that "this piece of car will be bought buck by BMWNA from this guy" (me). That what my SA told me today.

BMWNA will treat you right. With any complex, mass produced product, there will be X number of problems. BMW does an exemplary job of taking care of affected customers - so long as they do not turn into azzholes along the way. While you are within your rights to consult a lawyer, my advice is to wait and see what BMWNA offers before you go down that road.

They will prefer not to have the title branded as a lemon, so will most likely offer you a "trade assist" - i.e. put you into a 2015 with the same options as your 2014. BF member ard (small "a") on the E70 X5 forum has posted extensively about his trade assist experience. Taking a deep breath and searching out his posts will make you feel much, much better.

Don't count your chickens......

When dealing with any car dealership and the manufacturer, if you mention "lemon" most times they will forward the issue to corporate legal. You can discuss all the time in the shop, problems, times attempted to fix, comments made to you, etc.

Just because an SA says "they'll buy it back" doesn't mean anything. Again, you must be an active participant. If the dealer says "they'll contact, they'll do this, they'll do that"...be skeptical.

If they say the car is functioning under spec, and declare it so you're SOL on the easy part of having it bought back. I hope you get an easy resolve, but there are a number of 5 series customers that have problems, and BMW has dug in, and even with ultra obvious engine malfunctions they haven't bought the car back.

This is not a slam-dunk process. Some people have had good luck, others there have been games played.
