Looking to buy a C%

I current own a 2003 E39 that run like a tank, but need more room. I am looking at a 2004 X5 4.4 and a 2006 X5 3.0.

What should I look for in these used vehicles? Are these bad years?

Those are not bad years. You want to look for maintenance history and have a PPI done. The 3.0 would have pretty much the same engine as your E39 with larger displacement. I would rather have more power than less, so I'd get the 4.4.
