Exclamation Shift Lever! Malfunction - Misc Help

Hello everyone. I am brand new to the site but quite excited to own my first BMW. I live in Canada and currently own a 2007 X5 with 97,000kms. I bought it a week ago and I am find a few small issues that maybe people can help with.

1) Under the hood all the rubber that goes along the back top of the chassis and seals against the hood is all broken and the plastic was very brittle

2) The manual release on the hatch that plastic is broken

3) I put the vehicle into drive today and got the error Shift Lever! Malfunction. I have tried to search about this error code and didnt come up with anything. When shifting into drive from Park do I need to push in the button on the left. Seems to me that I didnt get the error when I pushed the button on the left but that might be a coincidence.

Any input would be greatly appreciated.

You must have your foot on the brake and push the button on the side otherwise you will get a warning.
