Passenger restraint malfunction
So some guy rear ended me slight ding under my trunk and the passenger restraint malfunction popped up.
called BMW and because it happened because of a collision it isnt covered by warranty and would have to either go through insurance or pay out of pocket the guy who hit me is just paying for the dent through a friend's bodyshop so my question is, would bmw know if i didn't tell them it happened because of an accident and just popped up? would it be covered by them then? please help!! |

It probably would not be. There's likely a trigger event in the ECU that will show when they run the codes. Besides, is it fair to hit BMW with the repair cost for something that is the fault of the guy who hit you?
Also, with a rear-end hit, there's a couple of systems that may have deployed. One is the active headrests (they'll be up and forward an inch or so if they went off). I didn't notice mine had initially triggered when I was rear-ended last summer, but I saw it the next time I got in the car. The seatbelt tighteners may also have deployed. You should have someone take a look at the systems. If they've deployed, you'll need to have them replaced and the guy who hit you should pony up, or you should go after his insurance.

Well normally i would have no problem going through insurance but no police report was filed because technically i don't have a valid license as of right now, my license was suspended but my doctor has cleared me i'm just waiting on the ok from the dmv, so going through insurance would screw me over more than him
