Mein Auto: 2015 535 M-Sport
Accident in our 2012 vert.

Yesterday my husband was on his way home and was hit by an uninsured motorist. He was making a left turn and the guy ran a red light. The car is pretty severely damaged on the drivers side. The roof looked a bit off on the passenger side too. BMW's service worked perfectly. He was called as the side airbag had deployed and they called for a tow truck.

Now we have to wait for the claims adjuster to call and see what the next step is.

How long does it usually take for them to figure out if it is a repair or a total loss?

Sorry to hear about the accident. I hope everyone involved is fine, health-wise.

I figure an insurance adjuster should give you an update on the estimated damages sometimes middle to end of next week. Usually the shop it was towed to will provide their estimate and an insurance adjuster will be by to approve and also inspect.

Looks like significant damage but given how new the car is, it may not be a total loss. I'd worry some how well that repairs with the retractable roof and all. Best of luck!

He seems to be ok so far ( a slightly sore neck and knee, but that is it at the moment) Thank you.

My major concern on the car is if the roof mechanism will be ok or not. It did look a little off to us on the passenger side.

It is a leased car with about 18 months left. Needless to say we won't be buying this one at the end of the lease.

Ouch! I hate that for you Judy! Glad your husband seems OK although I'm sure he is shaken up from that impact.

Doubt that is totaled given the high value of the car. Hopefully you have good insurance with a company that won't try to low ball you on the repairs. May have to be firm with them to see that everything is completely repaired to new standards.

I was going to say you should Google "diminished value" under California law but not sure if leasing will relieve you from that loss as the car will have a bad CarFax no matter how good the repair.

The car was towed to the local BMW dealer who will take it to their authorized repair shop today (Caliber). We have had many repairs done by them over the years (raising 3 new drivers is not cheap) Our insurance is supposed to send an adjuster out to see the car either today or Monday. I hope BMW does not try to "ding" us on diminished value. This was not an accident that was caused by either of us.

At least we have another car to drive as this was our "fun" car.

+1. She looks toast to me. That quarter panel is hammered pretty well. Between the axles hit may spell unibody frame damage. I know there isn't a true frame but wondering how well the car will track straightly (front wheels aligned with rear wheels). An E93 should be beefier down low but that was a hard hit. Blessings to you and your husband that he is okay.

No deductible as we have something in our policy on uninsured motorist coverage.

We are going off to the body shop this morning to give it another look and sign off on letting them work on it. At this point I'm really hoping it's totaled. If so we will trade in our 10 year old Lexus SUV and get an X5. No more little cars, but sure glad he was in the BMW.

Just looked at the car and it's really worse than we thought. We are hoping for a total loss. We don't want it back. the repair shop said they could replace the entire roof, but that it is 17K for just that.

I agree! Let your insurance company know you won't feel safe in the car even after it is repaired.

You will be selling the car if it is repaired and expect them to cover the diminished value on the car like surfcity335i recommended in his reply.

You had a new car now you have a wrecked car. I also think the repair is going to be substantial given the unibody is also most likely tweaked with the entire drivers side.
I don't know how this works given this is a leased vehicle and wish you the best of luck. By the way this isn't a little car it is 4000 pounds and your husband would have most likely incurred greater injury in a less car.
Please post what happens. Insurance companies vary greatly in how they handle claims...

If it appears the insurance company isn't going to declare it a total loss, you may want to get BMW Financial involved, since they are the actual owner of the car. BMW Financial has the resources to mount a legal fight with the insurance company. Let them fight the battle over inferior aftermarket repair parts, diminished value, etc.

Incidentally, as you already know, a tweaked convertible top is a very scary proposition.

I am sorry about your loss.

Car looks pretty like it's a goner. I'm betting there's some sort of frame damage. If they have to pull it, the car structurally isn't the same. You have a weak point in the car. Push to get totaled.

If your leasing through BMW, they have gap insurance factored into your lease, so there would be no "loss" on your end, if it's a total, then BMW will pull the gap insurance, and you'll be in a new car (and new lease!), V/r, Tim

She was a beautiful car. It hurts just to look at the pictures. However, I wouldn't call it a small car. She did what she was engineered to do, which was to protect the occupants. She was successful in that regard.

If you don't get another convertible, you will miss those top down days!

Wow, Glad your H is OK.
If the whole roof has to be replaces you are starting out with close to 20k before you get to any other body work. You have to think this is totaled. N4S

The car was my husbands baby. He took excellent care of it and when it needed to it took care of him. It's sad to see it like this, but better a hunk of metel then a person. We will push for a total if we need to and will get BMW involved if needed. I'm sure they are not going to want it back in 18 months.

It seems the B-pillar did it's job It held the door in place and prevented the side of the car from collapsing on the driver. Very impressive.

Agreed. He is one lucky guy. Not sure how fast the other driver was going, but at least 30mph, maybe faster and he didn't even try to stop.

So we are still waiting for the insurance co to asses the car, but we found out today that the driver who hit the car was......driving on a suspended license for 3 prior accidents without insurance, and he has two outstanding tickets. If the police had run his license he would have been arrested. He has several different names, but they all have the same address. UGH.

The appraiser is going out today Tuesday 9-10 so we should have his report and recommandation later today.

Uninsured and unlicensed drivers found at DUI check-points are a big problem in our state... but instead of cracking down on this problem, Sacremento (legislature) has actually "softened" the penalties and consequences of this...as it seemed "discriminatory." Go figure.
