From my limited experience of the CI engine the only reasons it will not start is lack of fuel, air or compression. It must have the correct mixture of vaporized oil and air at the correct time of the compression cycle. If you have fuel/air then you need to run a compression test.

Forgot to mention, only time it does start is if it's cold I.e mornings,
When it's warmed up it just turns.

Thanks again.

I have 4.4 x5, but I have a cummins too, same problem, and in my investigations I found that it is definately in the injection pump, mine was new as well, but sometimes from sitting on the shelf, the pump could have a bad diaphram in it, hope this will help.
