Trans acts like sport mode

Sometimes, my 2006 X3 w/ 5 sp. auto won't up shift. Almost always 3rd to 4th. It's as if I'm going up a hill or similar. I accelerate and then let off to try to get it to shift. Nope. I then put it in manual mode and go to the next higher gear. Mostly when it's cold, but will do it warm as well. Any ideas?

My 07 with the 6sp auto does this as well.

It didn't do it when I first got it. I have 125K miles.

@125k miles you should have change to box oil at 80-100k. As for the 5sp issue, is there a software update? Is the oil so old it might need changing even at those low miles?

BTW, all my fluids are up to date, pending a PS, brake and coolant flush.

could it be cold weather related? is the engine temp up to normal running temp when that happens? what if you go on the highway and go too fast for 3rd gear, will it eventually shift up?
