New E46 M3 owner. Sad story ensued.

I spent about the past two months or so doing my research and searching for an e46 m3. I wanted it black or silver and under 70,000 miles. I found the perfect one a few hours away from me at a BMW Dealership. Drove to check it out and it was immaculate, 2006, 6spd manual, 64,000 miles, and was inside on the showroom floor. Purchased it and loved everything about it, up until mile number 357 which was the next day...Engine died while doing 55. . Trailered it to a local BMW shop and the first thing the technician pulls out of the oil cap is a valve lash cap....not a good sign. Just thought I'd share the story will update on cause and results.

Dealership says any help they provide would be a gesture of goodwill. And that it's impossible to know how bad the damage is without me paying for a further inspection. Not hard to tell it needs a new engine right?

Is there not some kind of consumers guarantee law to protect you for this kind of thing, seems like they sold you a dud since it broke down the next day should be good grounds for legal help to return the car and collect your money.

Don't assume anything. Did you mean he pulled a shim out of the oil cap? That sounds odd. What was the engine noise like when it died? If you did your research you know there are many engine maladies with these cars that can happen at anytime regardless of age or mileage and most likely you were just at the wrong place at the right time.

It doesn't mean your car is toast. If you don't know what your looking at under the hood find someone you can trust that does.

The only noise the engine really made was a ticking sound. There was no stagger in power the car simply cut off with a ticking noise after. It would crank but wouldn't start. And yes it was a shim he pulled out of the top of the engine through the oil cap.

Here is in MA that would be covered by a mandatory warranty when buying used from a dealer.

Either way, don't panic, especially not before confirming that that this is indeed a dead engine.

Opened the valve cover today and had cam bolts sheared. Looks like at least a 7100 dollar fix. Dealer still isn't wanting to cooperate. Contacted BMW of North America today.

Did you buy the car "As Is" ??? Many states have used car warranty laws, many times its a 30 or 60 day. Seems South Carolina has no such laws. There should have been an 8X10 (approx) Used Car Warranty paper likely stuck on a rear side window that stated the vehicle either Has a Warranty, with a box checked, or the vehicle was being sold "As Is, with a box checked. That should have also been in your paperwork when you signed, and very like on your Purchase Order. Literally nothing online regarding to any State mandated Used Car Warranty. The only thing I could find was this,
"Implied Warranties - South Carolina laws say that a dealer has implied obligations, such as the soundness of the vehicle. In some states, however, dealers can get around implied warranties by selling the vehicle "as is."
Check your paperwork, though this I would think would have been something you knew about, were made aware of, entering into this purchase by the dealer. Cannot see BMWNA being much help. As J750 said, Consult with an Attorney, ASAP

It was implied that the car was a 9 out of 10 mechanically and cosmetically in an email prior to purchase. Also email states tires were in superb condition and I had the back drive side tire go low 175 miles later on the ride home. Legally I'm looking pretty concrete according to the lawyer by sell of deception. Thanks for all the responses I'll keep it updated.

And the lawyer said a salesman as is... is different from a judges as is.... just for cases exactly like mine. Simply because this isn't a 5k dollar Ford Explorer were talking about.

Latest Update

With at least a 7100 dollar repair bill, Thankfully my local dealership has worked with corporate BMW to cover half of the bill due to my situation. Three weeks without the car so far and the original dealership i purchased the car from has offered to pay half of my out of pocket cost and has attempted to "bully" me into negotians. I am planning on saving her waiting on a gasket set to come in from Germany at the moment. Thanks everyone. I'll give another update soon.

Honestly, if you get that much refurbished stuff for $3550 out of pocket on an e46 M3 that is a good deal long-term.

Got her back with a new top end rebuild. 700 miles into and she's running well. This is my first M3 and i love it.
