E64 6 Series convertible top class action

I've got official information on BMW's settlement of the class action lawsuit for 2004 - 2010 6 Series convertible tops. The class action claims that BMW made and sold certain E64 6 Series Convertibles with defective tops. As of April 26th 2017 BMW has entered into a nation wide settlement with the plaintiffs.

BMW will offer the following benefits as part of the settlement
  • Free software update for the convertible top installed on vehicles in the class action when they are brought to an authorized dealership within one year of the effective date of the settlement.
  • If the convertible top fails or displays "top not locked" error within one year of the date of the software update the convertible top will be repaired free of charged.
  • Reimbursement for out of pocket expenses for eligible repairs/replacement of the convertible top incurred subject to the following limitations:
    • Convertible Top Repair - Reimbursement for the cost of up to two eligible repair attempts prior to the effective date of the settlement.
    • Convertible Top Replacement - Reimbursement for the cost of one eligible replacement of the convertible top from a convertible top failure

These benefits will only be available after the effective date of the settlement. Class action members will receive written notice of the settlement via US mail in April 2017.

The final hearing for the case is schedule on or about July 20th 2017. The effective date of the settlement will be 30 days after the final hearing if the court grands final approval and their are no appeals.

Hi I recently bought a 650 2007 . The car was serviced previously at the dealership by previous owner therefore I took the car in for service. I am getting the top not locked message am eligible to have my topic nearby BMW dealership under the defective part

Yes but the settlement will not be final till late August.

Hi I was trying to sign up for the lawsuit but i do not have have previous receipts because i just purchased the car a month ago. What can i do to join the lawsuit? Thanks in advanced.

My top is locking I get noises from my top. Sometimes it's loud other times it's great no noise.

What year is yours mind seems to ding top not locked when it is really hot out and my trunk locks up I am scared to touch my top button afraid it will not open or maybe close. So missing the beautiful weather. Maybe they can pay me for that lol
love my car that's why I got convertible instead

You don't sign up unless you already paid for repairs.

Dealers will fix it at no charge.

Program will start end of July!

Yes, I'm getting the top not locked message. Haven't encourred any costs just want the software update. Do I need some kind of document for the dealer?
