Just stopped by BMW and ordered the new keyfob. $360.57.
Should be here in a couple days.
To get my comfort access back I need to schedule a service appointment to have them code it. I imagine that'll be another couple hundred or close to it.

I just had this problem come up last week in my e91 (that is the 3-series wagon). My problem turned out to be broken wires in the rear wiring harness that powers the diversity amp, which is a common problem as the e60 and e90 cars get older. The diversity amp is the device that communicates with the key fob. My suggestion is to get a new key from BMW so that you'll have a spare anyway. Use that new fob to prove if your issue is with the diversity amp.
