Rear end damage :(

Hey ! I have a 328ix . Recently got rear ended and wondering if y'all think it a total loss . Havent had an issue with the car , super clean . Hoping for the best but give me y'all thoughts and input .

Hrmmmmm. Depends on a lot of factors. There might be damage we can't see. What body shop rates in your area are like. Mileage and condition of vehicle. What the used car market is like in your area for buying a replacement. Etc etc etc. Looks like a decent amount of damage though. Obviously you're OK since you're posting, so glad to hear that.

A hit like that at the back can go either way.

From the front - yeah it would have been toast - from the back - could be fixed up.

Dude I'm sorry for your loss!
I know it sucks, but seems like it's going to be totaled.
However that really depends on the insurance.
Everyone operates differently.
Time for an upgrade?

The quite similar damage on my E92 was appraised at $7498 in 2012, although the total bill ran to around $12,000 by the time they were done (which included $2500 in rental car fees the other person's insurance had to cover). Car was repaired with all OEM parts, and rode just as well as before for the next 50,000 miles that I owned the car. The repairs included some minor damage to the hood and nose where I got pushed into the car in front of me, as well as resetting the active restraint systems that had fired.

I had the work done at Gaumond's in North Attleboro, halfway between Boston and Providence, RI. They're a preferred shop on a number of MA insurance company lists, but they don't cut corners because of it, and they're straight-up great, going to the mat to get OEM parts approved (legitimately, as unsuitable) when the appraiser was pushing for aftermarket. I've used them for out-of-pocket repairs in the past as well. Not the lowest price on the block, but they do great work.

The only complaint I could come up with was that they couldn't match the orange peel effect that was in the OEM paint.

And your's looks very similar to my rear-end hit. Mine was a 1997 BMW 328IS (E36) hit when 11 years old, 93k miles, super good condition.
I was stopped at a red light, car didn't see and got me at about 45 mph, pushed me just a bit into car in front. My car not damaged in front.
My starboard-rear corner was pushed in needing replacement of the entire back and side-rear quarter panels, trunk lid and insides, even the drivers seat was knocked off it's rails. (Good car though, I wasn't hurt a bit).

Their insurance agent inspected the car and declared it totaled. I think they said it would be $9-12k to fix and Blue Book value = $8,300

They offered $8,000 (they always offer just a bit less than BB)
+ 2-3 weeks car rental reimbursement, (during negotiations and then finding replacement)
+ unknown (several hundred dollars) for the week or so it was in the wreckers yard before I released it to the insurance agent.

This shows you how significantly that age figures into it. My car was almost certainly good for another 100k miles, but valued less than $8k.

i was rear ended by a corolla at slow speed. They replaced the bumper cover, which is just plastic and wraps around both sides, and a plate called an energy absorber behind the cover. You have more damage because your trunk lid is bent. Hopefully, you have no frame damage or damage to the trunk floor. If not, you get a new trunk lid, bumper cover, and energy absorber, may be some brackets I don't think it's a total loss. If there is a bent frame or bent trunk floor, push hard for total loss or diminished value. It will be hard to sell any car with frame damage.

Welcome to Massachusetts, where you cannot (per state court decision and all-the-way-up appellate review) get any payment for diminished value from your insurance company on the claim you are processing through them. Your contract with them is to repair it to prior condition per industry standards, and that's all they're going to pay for. Diminished value ain't gonna happen.

The only chance to get DV here might be to sue the other driver's insurance company or other driver personally in civil court. If if you were to somehow win (I don't know if anyone ever has), once you get done paying for the lawyer and the court costs, there's not going to be much, if anything, left.

+1 to this. Frames can be hard to get perfectly straight as well, even with modern frame machines. And it's not cheap in most places.
