Excess Oil Consumption -Class Action Settlement N63
I received notification this week of the class action settlement for model year 2009 - 2014 BMW vehicles with N63 engine. If your vehicle falls in this category check out the link below. I routinely had to add a quart of oil between scheduled oil services. The dealer at one point told me this was normal. Turns out that's not the case...

Check the link and the page for "Frequently Asked Questions" and under "what cars?" it has a chart of Year and Model's affected.

I need some help here. I had the N63 service package performed in 2015. My car, like others, regularly takes oil between changes. Not just 1 quart either -- I'd say 3 quarts on average. So it burns significant oil (BMW synthetic).
I just rec'd the class action notice. My car happens to be in for service and I asked to have an oil consumption test done. Response? "Well, the way we do that is we need to do an oil change first, so we can verify that the oil in your car is the correct oil." Seriously? That's ridiculous. Why? Because when my car burns excessive oil, I roll into the dealership service dept. and THEY "top off the fluids for free" -- and don't make ANY record of when they do this. So my questions are: - Are Oil Consumption Tests available for free? - Are Oil Consumption Tests available without having an oil change? - Is what the dealer is telling me accurate? I am very interested in going through the steps required to determine if I'm eligible for engine replacement. |

Hey, I was having the same problem. I'm also a member on bimmerPost. I seen a post on their forms about this same problem. I few guys were saying go to I high weight which I did(5w40) and my hasn't burned any oil. I'm using liquid Molly.

I hear you but that goes to show you that there is a problem. Unfortunately the word I am getting is that the dealers won't be able to any of the agreed to settlement work until the deal is finalized. I am hearing around September. In the meantime, keep all receipts for the oil, towing, etc that is related to the oil consumption issue and submit for reimbursement. Instructions is in the documents received from the attorneys. I've made 2 trips so far to the dealer for checks and adding oil.

Folks, those of you with one of the affected vehicles in the class action settlement might want to look through the proposed settlement and submit an objection because this problem, excess oil consumption, will impact you. I'm submitting an objection to the settlement asking the court to consider additional provisions to protect owners such as extended warranties, buyback options, etc. I have already incurred problems with premature failing of parts that, as I understand from a certified BMW mechanic, are more than likely directly related to excess oil consumption. The proposed settlement offers reimbursement for oil purchased between scheduled visits and a replacement engine if the vehicle fails two (2) oil consumption test. "Replacement engine" on a car history report is only going to mean a diminished value vehicle when you attempt to sell it on the private market. Personally, I think the settlement is much more favorable for the attorneys than for the owners. Well, You've been Warned!

We have a 2014 650i Gran coupe. How do we determine if it has an N63 engine or not? Thanks.
PS We bought this car when it came off lease with approx. 23K miles. Is BMW required to notify us of this issue.....this settlement? I don't think you need to worry about having the N63 in a 2014 650 GC....you likely have an updated version of the troubled motor....

I just called a local dealership, BMW North Houston, today and the service department has been instructed to not take any action concerning the lawsuit until the verdict has been published. For now no free oil consumption test.

I received the class action lawsuit paperwork this past summer, but misplaced same.
Do class members / claimants need to return any paperwork back to the administrator to be added to the class, etc.? If so, still time? Thank you! |

I’ve had cars with the N63, N63Tu, S63, and S63Tu. The S63Tu was the only one that regularly required a quart of oil prior to it’s 10kmi oil change. My N63 went well beyond 10kmi without needing any oil. I won't be participating in this class action suit.

Just FYI my car wouldn't pull up in the online database, but I emailed the settlement administrator and 2 weeks later they respond back saying my Vin is indeed in this group and they are mailing me claim forms. If you think you're in the class I recommend emailing them your Vin.

I spoke with my BMW dealership in Central Florida. The service advisor would not even acknowledge that there was even a class action suit in motion. He did say that if there was a judgement or ruling, the service department would be provided guidance from BMW NA on how to proceed. When asked about the oil consumption on the N63 engine, he stated that "adding 1 quart of oil every 750 miles is considered normal by BMW". I had to have him repeat that to make sure I wasn't hearing him incorrectly. So BMW recommends 15,000 miles between oil changes, it appears adding 20 quarts between oil changes is acceptable.
It will be interesting to see what comes out of the ruling October 10th but I'm not very optimistic. Maybe higher viscosity oil may be the only option. |
