Maybe the comment meant to say a N26 engine replacement is more expensive than N20 engine? If the TC issue is caught too late, the fix will be complete engine replacement.

July 13 will be the original date for last settlement conference before class action goes to trial.

Let's see if next wave of shutdown will derail that court date!

Today would have been the 'final pretrial conference' but it was cancelled. No new PACER entries today so I am hoping 7/13/2020 is still on the docket!

Ah your post said 7/13 is "to approve settlement", so without final pretrial conference, it will seem 7/13 date should be cancelled too?!?

Full docket text for document 66:
TEXT ORDER: The Court will hold an in person conference to approve the settlement on 7/13/20 at 11:30am in Courtroom 4D.. So Ordered by Magistrate Judge Cathy L. Waldor on 3/27/20. (tjg, )

I don't know the court system real well but perhaps they did it via telephone conference or they submitted their settlement papers. Hell, perhaps they came to an agreement and now its up to the court to finalize it... I check every day and will be attending the 7/13 hearing if allowed.

Way to go sjbender. Thanks for doing this and sharing the updates with us. I'm sure there are many more eyes watching your posts than the number of replies to them

Letter from Randee Matloff jointly requesting two week adjournment. (MATLOFF, RANDEE)

LETTER:
Magistrate Judge Cathy L. Waldor, U.S.M.J.
United States District Court
Martin Luther King Jr. Federal
Building & U.S. Courthouse
50 Walnut Street
Newark, New Jersey 07101
Re: Gelis et al. v. Bayerische Motoren Werke AG
Civil Action No 2:17-cv-7386 (CLW)
Dear Judge Waldor:
This firm, together with Kantrowitz, Goldhamer & Graifman, P.C.
and Thomas Sobran, P.C. represents plaintiffs in the above-referenced
action. We are writing, with the consent of Christopher Dalton on behalf
of BMW NA, to request a two-week adjournment of the return date for
Plaintiff's Motion for Preliminary Approval of the Class Action
Settlement, currently scheduled by the Court for July 13, 2020. The new
proposed return date would be July 27, 2020.
The parties are nearing completion of a final Settlement Agreement
but until the final requested revisions are approved, we are unable to
file a motion with a fully executed Settlement Agreement annexed by the
current deadline. We are hopeful that the additional two weeks will be
sufficient.
Case 2:17-cv-07386-CLW Document 68 Filed 07/06/20 Page 1 of 2 PageID: 2312
The parties respectfully request that the Court "So Order" this
adjournment request.
Very respectfully yours,
s/ Randee M. Matloff
RANDEE M. MATLOFF
cc: (All counsel of record- via ECF)

Wow, that's great news!

So is it a recall, or 10-years/150000 miles, or 15 years/150000 miles(at least for PZEV)?

I'm just hoping for partial reimbursement for preemptively paying having the timing chain replaced. I have the photos and the shop said it was making the sound - in the paperwork.

Wished it covered the turbo since that was going as well.

If yours is N26 in PA(which is PZEV state), the turbo will be covered 15 years/150000 miles, but it has to be diagnosed and fixed at dealer to be covered.

What mileage did yours give you issues?

Just had my N20 blow all of a sudden on the highway (2013 X3/F25 x28i).
Don't know the damage yet but it's seized and im at 73k miles and 7 years. Plenty of comments on the class action websites recently asking how to join with similar mileage.
I sincerely thank you for the updates and for anyone fighting this fight, god bless you.

Below is the response from one of the attorneys on the case. I emailed him asking for any update....nothing specific, but all of my previous requests were answered with a vague comment with no indication provided in either direction, as would be expected. Encouraging.....

Thanks, Brad. Still in significant discussions with the company which hopefully may materialize in some significant benefits to owners.

Regards,

GARY

It's a class action suite. You are a member if your product is in the list. In this case its the N20/N26 engine of certain model and year cars. You do not need to 'join'. However, if you have had expenses related to the case, you will likely need to have proof to be compensated.

Here is the original filed complaint; http://www.sjbender.com/bmw.pdf

Snippet from the filing;

"initiate this proposed class action involving the following vehicles: (i) 2012 through and
including 2015 model year BMW motor vehicles equipped with the N20 and N26 direct injection
turbocharged engine (hereinafter collectively "class vehicles" or "class vehicle") "

Understood, my interest was the comments of owners that encounter issues, e.g. what mileages, symptoms, CEL, severity(e.g. engine blown at middle of freeway at speed), etc, etc.

Ahhhh, that I don't know. The case filings is written in 'legalese' so you may be able to decipher that...
