E64 6 Series convertible top class action

I've got official information on BMW's settlement of the class action lawsuit for 2004 - 2010 6 Series convertible tops. The class action claims that BMW made and sold certain E64 6 Series Convertibles with defective tops. As of April 26th 2017 BMW has entered into a nation wide settlement with the plaintiffs.

BMW will offer the following benefits as part of the settlement
  • Free software update for the convertible top installed on vehicles in the class action when they are brought to an authorized dealership within one year of the effective date of the settlement.
  • If the convertible top fails or displays "top not locked" error within one year of the date of the software update the convertible top will be repaired free of charged.
  • Reimbursement for out of pocket expenses for eligible repairs/replacement of the convertible top incurred subject to the following limitations:
    • Convertible Top Repair - Reimbursement for the cost of up to two eligible repair attempts prior to the effective date of the settlement.
    • Convertible Top Replacement - Reimbursement for the cost of one eligible replacement of the convertible top from a convertible top failure

These benefits will only be available after the effective date of the settlement. Class action members will receive written notice of the settlement via US mail in April 2017.

The final hearing for the case is schedule on or about July 20th 2017. The effective date of the settlement will be 30 days after the final hearing if the court grands final approval and their are no appeals.

Hi I recently bought a 650 2007 . The car was serviced previously at the dealership by previous owner therefore I took the car in for service. I am getting the top not locked message am eligible to have my topic nearby BMW dealership under the defective part

Yes but the settlement will not be final till late August.

What year is yours mind seems to ding top not locked when it is really hot out and my trunk locks up I am scared to touch my top button afraid it will not open or maybe close. So missing the beautiful weather. Maybe they can pay me for that lol
love my car that's why I got convertible instead

You don't sign up unless you already paid for repairs.

Dealers will fix it at no charge.

I tried before I saw there was an appeal. Dealer here was actually being a little snotty about it even when I tried to show them the website. Basically until they are issued the VIN list by BMW nothing they could do, but they didn't have to get attitude. Now that the appeal was dismissed, just waiting to hear something more. Will call after holidays...

At this time, the settlement is still in an appeal process by BMWUS. We took our E64 in after we received the settlement notice but since they have not received the software update, (due to the appeal), the dealer would not do the fix. Last I heard the appeal is not expected to be hear until March at the earliest.

****ing lawyers, they are costing BMW more $$$$$$ than it would cost to just do the repairs and reimbursements.

UPDATE

The appeal of the Court's Order granting final approval of the Settlement has been dismissed and the Settlement is now effective. Reimbursement payments and deficiency notifications will proceed in accordance with the timeline set forth in the Settlement Agreement. Additionally, the Software Update will be released to authorized BMW service centers shortly. If you intend to seek a software update, you can contact your local BMW Service Center and make an appointment to have to the Software Update performed free-of-charge.

Last year the locks broke on the windshield. I signed up and was compensated. Now I am getting intermittent issues with the top not going up and down. BMW updated the software and said they replaced senosors and the problem still happening.
The issue is that the problem is not throwing error codes and BMW says there is nothing wrong. I have been there 4 times and again this morning the roof would not go up or down. I let the car sit for an hour...went out and the top went up.
How can I get BMW to fix this? I wrote the law firm and asked them what to do? BMW dealer said they would repair cost free until 08/01/2018. But if they keep pushing me off that nothing is wrong...I am afraid I will be stuck
Independent Garage (did not work on top) stated that they have hydraulic issues with the tops and that they have to pull the entire roof and replace the unit. I know BMW is being stubborn...but I want this fixed. Any advice?.
