i thought this issue was resolved earlier in the year. didn't bmw have to delay production for 2016 models because of the EPA investigations on other brands? now they have to do it again for 2017 models?

I believe it is every year, or it has been as far as I can remember.

Gotcha. I was under the impression this scrutiny was additional or ancillary to the original inspection process or further investigation because of the VAG/TDI issues.

I think that, given the VW scandal, the Transportation authority has changed its testing methodology to include road testing, instead of just testing in a lab. They are also probably paying more attention, and doing less "rubber stamping" because I am sure the VW scandal is embarrasing to them as well (the fact that some outside source found the issue and they didnt).
